About this file
This is a Drug-Free Workplace Affidavit document required for the Letcher County Fiscal Court's demolition services procurement in Kentucky. The affidavit establishes mandatory workplace drug policies that the responding firm must implement as a condition of bidding on the disaster-related property acquisition and demolition project. The contractor must publish a formal statement prohibiting the unlawful manufacture, distribution, dispensing, possession, or use of controlled substances in the workplace and must communicate this policy to all employees engaged in providing the commodities or contractual services under bid. Additionally, the contractor must inform employees of the dangers of drug abuse, available counseling and rehabilitation programs, and the penalties for violations.
The affidavit requires the contractor to provide each employee a copy of the drug-free workplace statement and to notify the employer of any conviction or guilty plea related to controlled substance violations occurring in the workplace within five days of such conviction. The contractor must impose sanctions on or require satisfactory participation in drug abuse assistance or rehabilitation programs for any convicted employee, with such programs to be sourced from the employee's community when available. The contractor must also make a good faith effort to maintain a drug-free workplace through continued implementation of these requirements throughout the contract term.
