About this file
This document is a justification for a sole source contract award. The contract requires maintenance services for ABB's Distributed Control System, which controls steam production across twelve plants located in Virginia and Pennsylvania. Services include preventative maintenance, corrective maintenance, rapid response services, an extended parts warranty, and a continuous assurance program. Training will also be provided on new software. The total contract value is estimated at $52.2 million over five years.
The justification cites that ABB's proprietary system and software requires specialized knowledge and support that only ABB engineers, who are factory trained and certified, can provide. An attempt to use third-party maintenance would require replacing the entire system at a cost over $5 million, disrupting operations and jeopardizing safety. Market research found no other options for the required services. The contracting agency determined this qualified as a sole source award under statutory authority for commercial items.

4. Statutory Authority Permitting SOLE SOURCE.
41 USC 1901(e)(2) – a sole source acquisition under the authority of the Simplified Procedures for Certain Commercial Items, as implemented by FAR 13.501(a).
5. Rationale Justifying Use of Cited Statutory Authority.
ABB’s Distributed Control System (DCS) is a computerized control system that controls the steam’s production line in the steam plant. The entire system of controllers is connected by networks for communication and monitoring. Local communication is handled by a control network with transmission over twisted pair, coaxial, or fiber optic cable.
ABB’s DCS uses custom designed processors as controllers and uses both proprietary interconnections and communications protocol for communication. Input and output modules form component parts of the DCS. The processor receives information from input modules and sends information to output modules. The input modules receive information from input instruments in the process (or field) and transmit instructions to the output instruments in the field. Computer buses or electrical buses connect the processor and modules through multiplexer.
Buses also connect the distributed controllers with the central controller and finally to the Human–machine interface (HMI) or control consoles.
ABB’s servers and applications processor is included in the system for extra computational, data collection, and reporting capability. Based on information received from remote stations, automated or operator-driven supervisory commands can be pushed to remote station control devices, which are often referred to as field devices. Field devices control local operations such
Source Selection Information – See FAR 2.101 and 3.104 3 as opening and closing valves and breakers, collecting data from sensor systems, and monitoring the local environment for alarm conditions.
ABB’s Distributive Controls Systems is considered to be the brain of the Thermal Commodity Optimization Network (TCON), which is all of the systems involved in managing the steam plant. NAVFAC has completed major upgrades and additions to the existing ABB Distributive Controls Systems throughout the region. These upgrades and additions were completed as part of the TCON, which is an Enterprise Management System designed by ABB.
All of the ABB SPlus servers, redundant servers, clients, and consoles operate using ABB’s software and products which are proprietary. Since ABB’s software is proprietary, ABB is the only company that can provide software support and upgrades. Additionally, ABB maintains ownership of the design documentation for the TCON system and employs the only engineers who are factory trained and certified to perform maintenance on their TCON system. Also, ABB does not provide for third party maintenance on its equipment.
In conclusion, procuring this continued specialized maintenance from another company would require replacement of the TCON system in its entirety. Based upon the cost of the existing system, the replacement cost would exceed $5 million. Replacing the entire TCON system would disrupt mission at commands, and in some cases lives would be jeopardized. Additionally, award to other than ABB would result in a substantial duplication of cost to the Government that is not expected to be recovered through competition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The requiring activity and contracting activity have conducted market research to determine if there are any other sources that can provide that required maintenance. Market research was conducted by the Contracting Officer and NAVFAC to identify existing contracts within the Department of Defense (DoD) to satisfy this effort. It was determined that the only existing DoD contract that is capable of providing the required training is the current contract which expires on 29 September 2023, which was awarded on a sole source basis. A Sources Sought Notice was posted on SAM.gov on 13 April 2023, to determine if there were any existing companies capable of performing this requirement. No responses were received. Market research determined that ABB is the only company that can provide the required maintenance.
7. Determination of Fair and Reasonable Cost.
A determination of fair and reasonableness of price will be based on the Contracting Officer’s price analysis of the contractor’s quote and/or a comparison of previous pricing history and published price list of the same or similar items in accordance with FAR 13.106-3.
8. Actions to Remove Barriers to Future Competition.
For reasons set forth in paragraph 5, FLCN has no plans at this time to compete future contracts for the type of services covered by this document. If another potential source emerges, FLCN will assess whether competition for future requirements if feasible. All future requirements will be dealt with on a case by case basis.
