About this file
This document is a justification and approval for other than full and open competition to award a sole source contract. The Naval Supply Systems Command intends to award a firm-fixed price contract to Benefactors' Counsel LLC to develop engagement plans and provide strategic planning counsel for five Navy museums over a one-year base period and one-year option period. The estimated value is $499,000. Benefactors' Counsel previously completed a preliminary study and two follow-on contracts involving proprietary data and close coordination with the museums, requiring a seamless transition. No other sources can replicate this work without duplication of costs or risk to mission consistency. The justification cites the unique requirements and proprietary information developed by the incumbent as the basis for the sole source award.

This action is for the award of a sole source firm-fixed priced contract to Benefactors’ Counsel LLC, Benefactor Group, 450 S. Front Street, Columbus OH 43215-5627 utilizing the authority of Other Than Full and Open Competition as permitted by 10 U.S.C. 2304(c)(1), and implemented by FAR 6.302-1, since there is only one responsible source and no other supplies or services will satisfy agency requirements.
3. Description of Supplies/Services:
The proposed acquisition is for support to assist five Navy Museums (U.S. Naval Undersea Museum, Keyport, WA; Puget Sound Naval Museum, Bremerton, WA; National Museum of the American Sailor, Great Lakes, IL; U.S. Navy Seabee Museum, Port Hueneme, CA; Hampton Roads Naval Museum, Norfolk, VA) in developing museum-specific engagement plans and provide strategic planning counsel. Continue to train and educate federal museum employees at the National Museum of the U.S. Navy, the Naval History and Heritage Command, and five other museums and related foundations in the Navy Museum Division on legal and ethical means of supporting new projects funded through public-private partnerships. Advise on building staff capacity that is museum specific. Tasks required for each museum include:
The Contractor shall develop museum-specific engagement plans which include:
Conduct discovery with the museum to identify needs and opportunities.
Create a written plan.
Provide implementation support and consulting.
Preparation for the training sessions for the U.S. Naval Undersea Museum, Keyport, WA, which will include:
Conduct quarterly training and capacity-building sessions (one onsite and three virtual) at the museum.
Work with the Naval History and Heritage Command to produce planning documents, including annotated agendas, resource documents, talking points, etc.
Create supplemental packets for each session containing an agenda, reference documents, and any materials needed for effective training.
Develop tools to help engage training participants and bolster conversation prior to the training session (i.e., creation of weekly survey, social networking site, and/or other tactics).
Present the report on the U.S. Naval Undersea Museum to key audiences including NHHC leaders and respective museum staff and non-profit campaign partners, and policy makers.
The Independent Government Estimate for a one-year Base Period and a one-year Option Period is in the amount of $499,000.00 The Independent Government Estimate was developed by NHHC based on estimates provided by Benefactor, historical contracts, reviewing the Internet and GSA.
Funding for the individual orders is anticipated to use Operations and Maintenance Navy (O&M,N) appropriations within the current fiscal year of the order requirement.
4. Statutory Authority Permitting Sole Source:
The statutory authority permitting Other Than Full and Open Competition is 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1(a)(1) and FAR 6.302-1(a)(2)(iii)(A), as identified in paragraph 5, since there is only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority:
The authority FAR 6.302-1(a)(1) cited in paragraph 4 above is applicable because the Government’s need can only be satisfied by the current contractor, Benefactors’ Counsel LLC, Benefactor Group. In 2021, Benefactor completed a preliminary study for NHHC that represented an investment of $140,000.00. The study involved hundreds of hours of work by NHHC staff employees, and close coordination with Benefactor representatives over dozens of meetings, both in-person and virtual. The close work with Benefactor was a time investment of five months of work for NHHC personnel. Benefactor, with oversight by NHHC, has already developed the data sets, utilizing their proprietary database for the required for statistical analysis.
As a result of this preliminary study, Benefactor was awarded two (2) sole source contracts, N0018921P0612 and N0018922P0600, to provided assessment, engagement planning, campaign feasibility and methodology studies, as well as training session to museum personnel to ensure members were able to build support for museum projects consistent with all applicable laws, regulations and policies as a continuation of the preliminary study obtained in 2021. This support was provided to the US Navy Museum located at the Washington Navy Yard.
This action is to provide the same analysis support to NHHC’s branch museums located at: U.S. Naval Undersea Museum, Keyport, WA; Puget Sound Naval Museum, Bremerton, WA; National Museum of the American Sailor, Great Lakes, IL; U.S. Navy Seabee Museum, Port Hueneme, CA; Hampton Roads Naval Museum, Norfolk, VA, to maintain consistency between all museums under the NHHC purview. Utilizing another Contractor to replicate the statistical analysis would result in a duplication of costs and effort, without benefit to the government. The NHHC requires a seamless transition from the initial, preliminary study work to the full campaign planning study. In addition, NHHC risks inconsistencies between what Benefactor has already developed and the results of another Contractor. This risk cannot be mitigated and would put NHHC’s mission at risk.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:
Due to the unique nature of this requirement, and that it is a follow-on for continued services currently being provided under contract N0018922P0600 for the US Navy Museum located at the Washington Navy Yard, no Sources Sought notices were issued to identify contractors in the marketplace due to the proprietary nature of Benefactor’s database or ability to continue the required support without mission risks to NHHC.
Benefactor does not utilize subcontractors who might be capable of providing the required support with continuity.
The Contracting Officer did review the Internet and GSA. While the results yielded several companies who might have the capabilities to provide support, they are unable to utilize the propriety database and provide continuity amongst the NHHC branch museums.
Based on the information collected research methods outlined above, there is not an expectation that two (2) or more acceptable proposals will be received. Therefore, the Contracting Officer’s recommendation is to issue a sole source award to Benefactors’ Counsel LLC, Benefactor Group.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the prices negotiated for this acquisition are fair and reasonable in accordance with FAR 15.404.
8. Actions to Remove Barriers to Future Competition: Currently there is no expectation that this support will be required after the period of performance of this action expires. Therefore, for the reasons set forth in paragraph 5, NAVSUP FLC Norfolk has no further plans, to compete future contracts for the type of services covered by this document. If another potential source emerges, NAVSUP FLC Norfolk will assess whether competition for future requirements is feasible.
