About this file

This is a Memorandum to the File documenting a justification for use of other than full and open competition under the simplified acquisition threshold (SAT).

Naval Air Systems Command (NAVAIR) is procuring dual bungee visors for the HGU-68/P flight helmet used by aircrew on all T-6 aircraft. The specific items required are 1000EA Visor Strap Assembly (Inner), P/N B7182, and 1000EA Visor Strap Assembly (Outer), P/N B7078, with a delivery date of September 30, 2026. The procurement justifies single-source acquisition based on exclusive licensing agreements, as the requirement is mandated by an official NAVAIR Interim Flight Clearance (IFC) that explicitly identifies the visors by proprietary part numbers (96D9738-2 and 96D9739-2) unique to the manufacturer. The IFC provides airworthiness approval and explicitly directs that the dual bungee visors be purchased directly from the specified manufacturer. Market research conducted via GSA e-Buy revealed zero vendors capable of providing the required straps as alternatives. The justification certifies that use of any other product would violate the flight clearance and compromise pilot safety, making the identified manufacturer the only responsible source capable of providing the certified equipment. Technical and contracting officer certifications are required with FLCJ Code 200 GS-14 or higher approval authority.

A. X ONLY ONE RESPONSIBLE SOURCE (select all that apply):

1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

2. _X__ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

The requirement for these specific visors is mandated by an official NAVAIR Interim Flight Clearance (IFC) which provides airworthiness approval for their use on T- 6 aircraft. The IFC explicitly identifies the visors by their proprietary part numbers (96D9738-2 and 96D9739-2), which are unique to the manufacturer, .

Paragraph 7.A of the IFC further directs that the "DUAL BUNGEE VISORS CAN BE PURCHASED DIRECTLY FROM ..." This flight clearance is the result of a formal airworthiness assessment and safety review by NAVAIR, making the specified . visors the only components certified to meet the Government's needs for this application. Use of any other product would violate the flight clearance and compromise pilot safety. Based on this NAVAIR directive, . is the only responsible source capable of providing this brand-name, certified equipment.

Note: An RFI was conducted via GSA e-Buy for authorized resellers of brand name for the original suggested sources of the Dual Bungee Visor straps. Market research revealed zero (0) vendors capable of providing the required straps. , SAM

UEI: .

3. ___ OTHER REASONS.

B. N/A BRAND NAME. Item required must be a brand name or equal product, or feature of a product, particular to one manufacturer.

C. N/A UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified:

2. Required delivery date/period of performance:
