About this file
This document is a Justification for Brand Name Exception to Fair Opportunity for FEMA, seeking to procure a trailer-mounted Chiller System from Whaley Products. The specific equipment is a 100 Ton air-cooled chiller unit with detailed technical specifications, including 480V, 3 Phase power, low ambient package, R32 refrigerant, BACNET communications, and a pump station. The system includes eight 4" x 50' hoses, 200' of electrical cord, and various connectors and adapters.
The procurement is justified as a turn-key emergency cooling solution, with an estimated cost of $375,000 in FY25. FEMA's market research determined Whaley Products is the only vendor willing to provide a complete, portable trailer-mounted chiller package. The purpose is to provide emergency cooling for buildings during equipment repairs, addressing potential supply chain delays in obtaining replacement parts or units. The requirement will be posted on SAM.gov, and the procurement is being made under FAR 16.505(a)(4) with a statutory exception for a unique, highly specialized product.

Justification for Brand Name Exception to Fair Opportunity Exceeding the micro-purchase threshold and up to the SAT pursuant to FAR 16.505(a)(4)
JEFO No.
Date: September 18, 2025 PR Number: WX0481Y2025T
1. Nature and/or description of the item/service being procured and anticipated cost:
The proposed action is anticipated to be a firm fixed price purchase or delivery order to provide a Trailer mounted Chiller System on a pintle hitch trailer with a 100 Ton air cooled chiller unit, 480V, 3 Phase, MCA – 260.00, MOCP – 300.0, Low Ambient Package, R32 Low GWP refrigerant compliant with EPA AIM Act, and BACNET communications. Pump station with single pump package, 240 GPM @ 65psi, suction and discharge valves, discharge check valve and discharge expansion joint. Piping to have fill ports for filling system on suction and discharge side of pumps, and tees and valves for pump. Cam Locks installed on side of chiller for quick connect. 4” inlet and outlet piped to side of trailer with strainer and butterfly valves.
Fully Factory wired. Simple panel mounted toggle switch with clear labels for determining which amp-level you will run at for a given location. Eight (8) each 4” x 50’ long hose with C x E ends. 200’ of 300 amp rated electrical cord to connect to power at location. Adapters to get from 6” to 4” water connections. High Voltage quick disconnect fittings.
The purpose of this chiller is to provide emergency cooling to building on site until the buildings cooling system can be repaired. With todays supply chain’s inability to keep up with the demand, it can take a few months to obtain the necessary replacement parts and or units.
This is a request for approval of brand name justification for Whaley Products, estimated cost of $375,000.00 in FY25.
2. Statutory Exception and rationale for brand name. Only one awardee is capable of providing the supplies required at the level of quality required because the supplies are unique or highly specialized pursuant to FAR 16.505(b)(2)(i)(B) and is an item peculiar to one manufacturer:
FEMA intends to procure a brand name specification for Whaley Products in accordance with FAR 16.505(a)(4)(i) or (ii). During the market research to find vendors who would be able to supply a trailer mounted 100 ton chiller system, we only found one vendor willing to provide a complete package on a trailer to make the unit portable. There are companies that provide the subcomponents to build such a unit, but we are looking for a turn key solution.
3. FEMA intends to post this requirement on SAM.gov pursuant to FAR 16.505(b)(2)(ii)(D).
