About this file

This document is a Business Request for GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form issued by the Utah State Archives' Office of the Government Records Ombudsman. The form is designed to allow businesses to request confidential treatment of certain submitted documents, specifically addressing protection of trade secrets and commercial financial information under Utah Code § 63G-2-305. The form requires claimants to provide a concise statement supporting their confidentiality claim and mandates that they submit both redacted and non-redacted versions of their proposal, with a clear warning that the entire proposal cannot be redacted.

Key procedural requirements include that the confidentiality claim must include specific reasons for protection and be submitted alongside the information seeking protection. The Division of Purchasing will not perform redaction on behalf of the claimant, meaning the business must proactively provide a redacted version. Additionally, the form emphasizes that making a confidentiality claim does not guarantee the information will be permanently classified as confidential if a government records request is received. The form provides space for the claimant to specify which specific pages, paragraphs, and reasons underpin their confidentiality request, and requires the claimant's signature and date to validate the claim.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
