About this file

This document is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman for use in conjunction with the State of Utah Division of Purchasing's Request for Statements of Qualifications (RFSQ) for engineering analysis services related to the Newfoundland Basin Water Augmentation to the Great Salt Lake. The form allows vendors responding to the AS27-126 procurement to protect trade secrets and commercial financial information from public disclosure under the Government Records Access and Management Act (GRAMA), specifically citing Utah Code 63G-2-305 and 63G-2-309. Vendors claiming confidentiality protection must submit both redacted and non-redacted versions of their proposals, provide a concise written statement of reasons supporting the claim, and complete all required fields including company information, contact details, and specification of which pages and paragraphs contain confidential material.

The confidentiality claim process does not guarantee protection if the government receives a public records request, as final classification decisions remain subject to governmental review and applicable law. Vendors are responsible for submitting their own redacted proposals; the Division of Purchasing will not perform redactions on behalf of claimants who fail to provide a properly redacted copy. The form serves as the mechanism by which vendors can assert their confidentiality rights concurrent with their qualifications submission for this professional services procurement, which seeks a design professional services provider for a contract beginning April 1, 2027. No pricing information should be included in qualifications submissions, as vendor selection will be based on ranking, with the highest-ranked vendor invited to negotiate fair and reasonable compensation terms with the Office of the Great Salt Lake Commissioner.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
