About this file

This is a Government Records Access and Management Act (GRAMA) Business Confidentiality Claim Form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with Utah's Bureau of Forensic Services Document Control System Request for Proposal. The form is used by vendors to claim protection of trade secrets and commercial financial information submitted in response to the State of Utah Division of Purchasing's procurement for updates, support, and maintenance services for the Qualtrax Document Control System. The RFP anticipates a single contract award to the responsive and responsible vendor with the highest score, with a contract term of five years. Vendors must guarantee their pricing for a minimum of one year.

The confidentiality claim form requires claimants to submit both redacted and non-redacted versions of their proposals, with the entire proposal prohibited from redaction. The form mandates that claimants provide concise statements of reasons supporting their confidentiality claims and include detailed company information, including company name, address, representative contact details, and specification of which pages and paragraphs contain protected information. Per Utah Code 63G-2-305, trade secrets and commercial financial information that could result in unfair competitive injury are eligible for protection upon submission of a proper confidentiality claim, though such claims do not guarantee protected classification if the government receives a public records request. The Division of Purchasing will not redact proposals on behalf of vendors who fail to submit redacted versions.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
