About this file
This is a Business Confidentiality Claim form from the Utah State Archives Office of the Government Records Ombudsman, submitted in connection with the State of Utah Division of Purchasing's procurement for a Wilson's Phalarope Conservation Agreement and Strategy (CAS) development contract. The form serves as the official mechanism for vendors to claim trade secret and commercial financial information protections under Utah Code sections 63G-2-305 and 63G-2-309. The confidentiality claim must accompany the vendor's proposal submission and requires a concise written statement explaining the reasons for protection. Vendors are required to submit both redacted and non-redacted versions of their proposals, as the Division of Purchasing will not perform redactions on behalf of claimants. The contract, issued by the Utah Division of Wildlife Resources (UDWR) and the Public Lands Policy Coordinating Office, has an anticipated performance period of 12 months with an contract term of 18 months to accommodate final invoicing and administrative closeout.
The confidentiality claim process does not guarantee that information will receive protected classification if the state receives a subsequent records request under Utah's GRAMA statute. Vendors must complete all required fields on the form, including company name, address, contact information, and a detailed explanation of which specific pages and paragraphs require confidential treatment along with the corresponding justifications. The claim must be dated and signed by the authorized company representative. No pricing information, evaluation criteria, funding sources, or set-asides are specified in this confidentiality claim document itself, as it functions solely as a procedural form for asserting record protection claims during the proposal submission process.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
