About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the State of Utah Division of Purchasing's Request for Proposal for Utah's Bureau of Forensic Services Document Control System. The RFP seeks a single vendor to provide updates, support, and maintenance for the Qualtrax Document Control System for the Department of Public Safety. The anticipated contract term is five years, with vendors required to guarantee pricing for a minimum of one year. The procurement is anticipated to result in a single contract award to the responsive and responsible vendor achieving the highest evaluation score.

The Business Confidentiality Claim form provides a standardized template for bidders to submit protected information in accordance with Utah Code provisions governing trade secrets and commercial financial information. Claimants submitting proposals must provide both redacted and non-redacted versions of their proposals, with the Division of Purchasing declining to perform redactions on behalf of vendors who fail to submit compliant documentation. The form requires claimants to provide detailed justification for confidentiality protection claims, including specific page numbers, paragraphs, and detailed explanations of competitive harm that would result from public disclosure. Confidentiality claims do not guarantee protected classification if the government receives subsequent public records requests under the Government Records Access and Management Act.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
