About this file

This is a GRAMA Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the ELEV8 Utah - Experience Development Program, a professional services procurement conducted by the State of Utah Division of Purchasing and the Governor's Office of Economic Development - Utah Office of Tourism. The procurement seeks qualified companies to co-develop curriculum and practical toolkits for the ELEV8 Utah program under Administrative Rule R33-105 for Small Purchases of Professional Service Providers and Consultants. The form establishes the process by which vendors submitting qualifications can assert claims of business confidentiality for trade secrets and commercial financial information included in their proposals, in compliance with Utah Code sections 63G-2-305 and 63G-2-309. Vendors must submit both redacted and non-redacted versions of their proposals, with the form requiring detailed identification of specific pages, paragraphs, and reasons for each confidentiality claim.

The small purchase threshold for this procurement is set at $100,000.00, and vendors are explicitly instructed not to include pricing in their submitted qualifications. The confidentiality claim process requires vendors to provide concise statements of reasons supporting their claims, submit complete claimant information including company name and representative contact details, and designate the specific governmental entity receiving the submission. The form notes that submission of a confidentiality claim does not guarantee protected classification should the government receive subsequent records requests under Utah's Government Records Access and Management Act (GRAMA). This document serves as the mechanism through which bidders can protect sensitive business information while participating in the procurement process.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
