About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in conjunction with a Registered Dietitian for Institutional Menu Planning/Review procurement conducted by the State of Utah Division of Purchasing on behalf of the Department of Corrections. The procurement seeks a Registered Dietitian to provide professional services for institutional menu planning and review under a five-year contract term. The vendor selection will be conducted under Utah Procurement Code 63G-6a Part 15 for Design Professional Service Providers and Consultants, with the highest-ranked vendor selected to negotiate contract terms at fair and reasonable compensation rates determined through negotiation rather than competitive bidding.

The confidentiality claim form allows vendors submitting qualifications to protect trade secrets and commercial financial information from public disclosure under Utah Code 63G-2-305 and 63G-2-309. Claimants must submit both redacted and non-redacted versions of their proposals, with the entire proposal not subject to complete redaction. The form requires claimants to provide concise statements of reasons supporting their confidentiality claims, including company information, contact details, and specification of which pages and paragraphs require protection. The procurement instructions explicitly state that no pricing information should be included in qualifications submissions, and that making a confidentiality claim does not guarantee protected classification if the government receives a records request under the Government Records Access and Management Act (GRAMA).

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
