About this file

This is a Claim of Business Confidentiality document submitted by a conducting procurement unit in Utah regarding Contract 216363 Amendment 6, which involves an extension and funding increase. The document supports the state's Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process, indicating that the procurement unit has asserted business confidentiality claims regarding specific information related to this contract amendment. The file serves as justification for awarding the contract without competition, citing circumstances that make a standard procurement process impractical and not in the best interest of the procurement unit. The confidentiality claim protects proprietary or sensitive business information from public disclosure while allowing the procurement to proceed through a non-competitive award process under Utah's procurement code provisions.

The claim of business confidentiality designation restricts access to detailed information regarding pricing terms, incumbent details, current performance metrics, and specific funding requirements associated with the contract amendment. By invoking business confidentiality protections, the conducting procurement unit prevents disclosure of commercially sensitive data that could compromise competitive positioning or reveal proprietary methodologies. This confidentiality claim is integral to the justification for proceeding with a non-competitive award, as it allows the state to maintain the confidential nature of information that would typically be disclosed in a standard procurement process while still documenting the procurement unit's rationale for the sole-source or non-competitive award decision.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
