About this file

This is a Claim of Business Confidentiality filing related to a broker and consulting services procurement conducted by the Utah System of Higher Education (USHE) on behalf of the State of Utah Division of Purchasing. The document concerns a Request for Statements of Qualifications (RFSQ) for a firm to design, procure, implement, and provide ongoing support for a consolidated employee health and welfare benefits program across all USHE member institutions. The selected firm will serve as the Board's broker and consultant of record, with a target effective date of July 1, 2027. The procurement is being conducted under Utah Procurement Code 63G-6a Part 15 for the purchase of Design Professional Service Providers and Consultants, with the highest-ranked vendor selected to negotiate a contract at fair and reasonable compensation to be determined during negotiations.

The confidentiality claim indicates that one or more vendors have submitted proprietary or confidential business information as part of their qualifications statements, which they are requesting be protected from public disclosure. This type of filing is standard in competitive procurement processes where firms submit sensitive information regarding their methodologies, pricing approaches, client lists, or other competitive intelligence. The claim allows vendors to clearly identify materials they consider confidential while still participating in the public procurement process, ensuring that commercially sensitive information can be appropriately redacted from public records while maintaining the integrity and transparency of the overall procurement evaluation.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
