About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with Request for Proposal NC26-78 issued by the State of Utah Division of Purchasing on behalf of the Department of Environmental Quality. The RFP seeks a vendor to provide laboratory analysis of trace metals in tissue samples collected from the hypersaline waters of Great Salt Lake. The contract is anticipated to have a single award to the responsive and responsible vendor with the highest evaluation score, with a contract term of five years.

Vendors submitting proposals must guarantee their pricing for the first 12 months of the contract. The form requires claimants seeking protection of proprietary information under Utah Code 63G-2-305 to submit both redacted and non-redacted versions of their proposals, with a concise statement of reasons supporting any confidentiality claim. The Division of Purchasing will not redact proposals on behalf of claimants who fail to provide a redacted version. Making a confidentiality claim does not guarantee protected classification if the government receives a records request under the Government Records Access and Management Act (GRAMA).

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
