About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the State of Utah Division of Purchasing's solicitation BD26-78 for automated sauna services at Utah State Parks. The procurement seeks a five-year concession agreement to provide non-permanent and automated sauna services at three locations: Willard Bay State Park, Utah Lake State Park, and Wasatch Mountain State Park. A mandatory in-person site visit is required on Monday, June 8th at 10:00 AM at Wasatch Mountain State Park Visitor's Center, located at 1281 Warm Springs Road, Midway, Utah 84049. Per Utah Procurement Rule R33-101-13, an authorized representative of each bidding entity must attend the entire site visit; late arrivals are not permitted to continue, and failure to attend results in bid disqualification. An attendance log documenting all attendees, their represented entities, contact information, site visit minutes, and distributed documents will be published as a solicitation addendum, and any verbal modifications made during the site visit will be reduced to writing and similarly published.
The Business Confidentiality Claim form provided allows bidders to assert protected status for trade secrets and commercial financial information submitted in response to the procurement, in accordance with Utah Code 63G-2-305 and 63G-2-309. Claimants must submit both redacted and non-redacted versions of their proposals, with the entire proposal being ineligible for complete redaction. The form requires claimants to provide concise statements of reasons supporting their confidentiality claims, including company information, specific pages and paragraphs subject to protection, and detailed justifications for each claimed protection. The Division of Purchasing will not perform redactions on behalf of bidders who fail to submit properly redacted proposal copies. Submission of a confidentiality claim does not guarantee protected classification if the government receives subsequent records requests under the Government Records Access and Management Act.

A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected.
