About this file

This is a Business Confidentiality Claim Form issued by the Utah State Archives Office of the Government Records Ombudsman in support of the State of Utah Division of Purchasing's Request for Proposals (RFP) for an H.B. 250 Retirement Plan Exchange Platform Administrator. The RFP, conducted by the Office of State Treasurer, seeks a single vendor to establish, administer, and maintain a secure, publicly accessible Retirement Plan Exchange in accordance with Utah Code Section 67-4-23. The anticipated contract term is five years, with the vendor required to guarantee pricing for the entire contract duration.

This form serves as the mechanism for vendors submitting proposals to claim protection for trade secrets and commercial financial information under Utah Code Sections 63G-2-305 and 63G-2-309. Vendors submitting proposals must provide both redacted and non-redacted versions of their proposals, with the Division of Purchasing declining to perform redactions on behalf of claimants who fail to submit redacted copies. The confidentiality claim does not guarantee protected classification if the government receives a records request, and claimants must provide a concise statement of reasons supporting their claim for any information they seek to protect from public disclosure.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
