About this file

This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the State of Utah Division of Purchasing's request for qualifications (RFSQ) for orphan well equipment decommissioning and surface restoration services. The procurement seeks qualified Design Professional Service Providers and Consultants to perform decommissioning of equipment on location, disposal of related wastes, surface restoration to original grade, and reseeding of locations under a five-year contract term. The vendor submission process requires both redacted and non-redacted versions of proposals to be submitted to the Division of Oil, Gas and Mining. The state will rank vendors based on qualifications and award the contract to the highest-ranked vendor to negotiate compensation determined to be fair and reasonable, with provisions to proceed to the next highest-ranked vendor if negotiations with the top-ranked vendor fail.

The confidentiality claim form provided is a template document that allows bidders to protect proprietary trade secrets and commercial financial information from public disclosure under Utah Code 63G-2-305 and 63G-2-309. Claimants must submit a concise statement of reasons supporting confidentiality protection for specific pages, paragraphs, or sections of their proposals. The form requires identification of the company, company representative contact information, the governmental entity receiving the submission, and detailed reasons for each confidentiality claim. Importantly, making a confidentiality claim does not guarantee protected classification if the government receives a records request, and the Division of Purchasing will not redact proposals on behalf of claimants who fail to submit a redacted copy. No pricing information is to be included in qualifications submissions for this procurement.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
