About this file
This file is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in conjunction with the State of Utah Division of Purchasing and the Division of Wildlife Resources for the NC26-46-1 Feasibility Study for Jetty-Pier Fishing Program. The document serves as a template for vendors responding to the Request for Statements of Qualifications (RFSQ) to claim protection of trade secrets and commercial financial information under Utah Code 63G-2-305. The procurement seeks qualified design professional service providers and consultants to conduct a feasibility study identifying suitable locations for construction of a rock jetty or pier to provide safe and convenient public fishing access at Utah Lake. The contract will be awarded under Utah Procurement Code 63G-6a Part 15, with the highest-ranked vendor selected to negotiate a contract based on fair and reasonable compensation. Vendors are explicitly instructed not to include pricing in their qualification submissions.
Claimants submitting confidential information must provide both redacted and non-redacted versions of their proposals, with the understanding that confidentiality claims do not guarantee protected classification if the government receives public records requests under GRAMA (Government Records Access and Management Act). The Division of Purchasing will not perform redactions on behalf of claimants who fail to submit a redacted copy. The confidentiality claim requires a concise statement of reasons supporting the claim, including specific identification of pages, paragraphs, and reasons for protection of each section. All claims must be submitted simultaneously with the vendor's proposal to be considered for protection under state law.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
