About this file
This is a Business Confidentiality Claim form prepared for the State of Utah Division of Purchasing and the Department of Agriculture and Food in connection with the NC26-55 FOSS Bacsomatic Maintenance contract opportunity. The form serves as a template for vendors submitting proposals to assert claims protecting trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. Vendors must submit both redacted and non-redacted versions of their proposals, with the redacted version identifying specific pages, paragraphs, and reasons for confidentiality claims. The maintenance contract is for a FOSS Bacsomatic instrument with a contract term of one to five years depending on funding availability, and the procurement is anticipated to result in a single contract award to the responsive and responsible vendor with the highest score in accordance with state procurement code.
Pricing must be guaranteed for one year, with any future price increases requiring submission of market research documentation and agency approval, with each approved increase guaranteed for an additional one-year period. The form requires claimant information including company name, address, representative contact details, and the governmental entity to which records are submitted. The confidentiality claim does not guarantee protected classification status if the government receives subsequent public records requests. Vendors must complete all required fields and submit the form with their proposal; failure to provide a redacted proposal version will result in the Division of Purchasing declining to redact the submission on the vendor's behalf.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
