About this file
This is a GRAMA Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman, applicable to the State of Utah's Request for Information (RFI) regarding a feasibility study on the potential merger of the Division of Licensing and Driving (DLD), Department of Motor Vehicles (DMV), and Motor Vehicle Enforcement Division. The RFI relates to Senate Bill SB0237 and seeks to determine the cost of conducting a feasibility study examining the consolidation of these three state agencies. The form permits vendors and potential respondents to submit trade secrets and commercial financial information with confidentiality protection claims, provided they comply with Utah Code provisions 63G-2-305 and 63G-2-309. Respondents must submit both redacted and non-redacted versions of their proposals, with the entire proposal unable to be fully redacted. The State of Utah's Division of Purchasing will not redact proposals on behalf of claimants who fail to provide a redacted copy.
The confidentiality claim form requires detailed claimant information including company name, address, representative contact details, and a concise statement of reasons justifying the confidentiality request. Claimants must specify which pages, paragraphs, and sections of their submission warrant protection and provide corresponding reasons for each designation. The RFI explicitly states that submission of a confidentiality claim does not guarantee protected classification status if the government receives subsequent records requests under GRAMA. This RFI is not a procurement process and cannot be used to award contracts; rather, it serves to gather vendor input, assess interest, and determine whether to proceed with a formal invitation for bids or request for proposals. All vendor communications must occur through RFI responses or designated question-and-answer periods, with direct contact with the State discouraged.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
