About this file

This is a GRAMA Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with an Environmental Monitoring for Art Preservation contract opportunity managed by the Division of Purchasing. The form is designed to allow vendors and contractors to protect proprietary information, trade secrets, and commercial financial information from public disclosure under Utah's Government Records Access and Management Act (GRAMA). The claimant must submit both redacted and non-redacted versions of their proposal, with specific designation of which pages and paragraphs contain confidential information and the corresponding reasons for protection. The form requires detailed claimant information including company name, address, company representative contact details, and a concise statement explaining why the information warrants confidential classification.

The confidentiality claim process is governed by Utah Code sections 63G-2-305 and 63G-2-309, which permit protection of trade secrets and commercial financial information that could result in unfair competitive injury if disclosed. Importantly, submission of a confidentiality claim does not guarantee protected classification if the government receives a public records request; the Division of Purchasing retains the authority to determine final classification status. Claimants must complete the form with all required fields including the specific pages, paragraphs, and detailed reasons for each confidentiality request. The Division of Purchasing will not perform redactions on behalf of vendors who fail to submit properly redacted proposal copies.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
