About this file

This file is a Government Records Access and Management Act (GRAMA) Business Confidentiality Claim form issued by the Utah State Archives and the Office of the Government Records Ombudsman, applicable to the State of Utah Division of Purchasing's procurement for a Southern Utah Regional Managing Defender position. The form serves as a template for vendors submitting proposals to claim protected status for trade secrets and commercial financial information in accordance with Utah Code §63G-2-305 and §63G-2-309. Claimants must submit both redacted and non-redacted versions of their proposals, with the entire proposal submission prohibited from being fully redacted. The form requires vendors to provide their company information, identify specific pages and paragraphs subject to confidentiality claims, and supply concise statements of reasons justifying each claim for protection.

The confidentiality claim does not guarantee protected classification status if the state receives public records requests following proposal submission. Vendors must complete all required fields including company name, address, representative contact information, the governmental entity involved, and detailed explanations for each confidentiality claim with corresponding page and paragraph references. The Division of Purchasing will not redact proposals on behalf of claimants who fail to submit properly formatted redacted copies alongside their submissions. This form is part of the procurement process for a three-year contract award to provide regional managing defender services in Southern Utah, with the contract anticipated to be awarded to the highest-scoring responsive and responsible vendor.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
