About this file

This is a GRAMA Business Confidentiality Claim form from the Utah State Archives and Office of the Government Records Ombudsman, filed in connection with an Appellate Counsel in Juvenile Delinquency contract opportunity issued by the State of Utah Division of Purchasing under the Governor's Office. The form provides a template for vendors to submit confidentiality claims for trade secrets and commercial financial information included in their proposals, in accordance with Utah Code 63G-2-305 and 63G-2-309. The RFP is anticipated to result in multiple contract awards to responsive and responsible vendors meeting the minimum technical score threshold, with a contract term of five years.

The confidentiality claim form requires claimants to submit both redacted and non-redacted versions of their proposals, with detailed documentation of which specific pages, paragraphs, and sections contain confidential information and the reasons for protection. Claimants must provide their company information, contact details, and a concise statement explaining why disclosure of the specified information could result in unfair competitive injury or reveal trade secrets. The form emphasizes that submission of a confidentiality claim does not guarantee protected classification if the government receives a GRAMA records request, and that the Division of Purchasing will not redact proposals on behalf of claimants who fail to submit properly redacted copies.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
