About this file

This document is a GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form from the Utah State Archives' Office of the Government Records Ombudsman, specifically related to a procurement process by Alpine School District. The form provides guidance for businesses seeking to protect sensitive information during a state and local contract opportunity, outlining the legal framework under Utah Code for claiming confidentiality of trade secrets and commercial financial information.

The form requires businesses submitting confidential information to provide a redacted and non-redacted version of their proposal, with a detailed explanation of why specific information should be protected from public disclosure. While the form does not specify the exact contract details, the related contract opportunity is a Notice of Intent to Award for Brigham Young University's Center for the Improvement of Teacher Education and Schooling (CITES), with Alpine School District indicating an intent to award a contract without engaging in a standard procurement process. Potential vendors are instructed to submit challenges or alternative proposals via email to Kimberly Richards if they believe they can meet or exceed the specified procurement requirements.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
