About this file

This is a Notice of Proposed Sole Source Procurement Request for Information (RFI) issued by Salt Lake County's Division of Contracts and Procurement for the Eccles Black Box Theater project. Salt Lake County seeks to procure Gallery 3 Chairs by Hussey Seatway, including installation labor and necessary parts, as a bleacher chair addition to the theater. This procurement is classified as a standardization request that represents a continuation of the previously competitively bid contract awarded for the theater's construction. The notice was posted on February 23, 2026, with comments due by March 2, 2026, at 1:00 PM Mountain Time. Interested parties who believe the sole source justification is not applicable must submit objections to Bibi Whitehead at bwhitehead@saltlakecounty.gov prior to the comments due date.

The estimated procurement cost is $84,000. The sole source justification is based on the proprietary nature of the Hussey Seatway Gallery 3 Chairs, which are compatible only with the existing railing-mounted seating support system currently installed in the theater. Norcon Industries, Inc. is identified as the sole source capable of providing, installing, and maintaining these proprietary materials. Alternative manufacturers' chairs would not properly integrate with the existing system and would require costly modifications or replacement of the support infrastructure, creating additional expenses, project delays, and potential safety and code-compliance concerns. Responses should be sent directly to the contact person and not submitted through the Utah Public Procurement Place. All submitted documents will be treated as protected records under Utah's Governmental Records and Access Management Act until contract execution or two years from the RFI issuance date, whichever occurs first.

NOTICE OF PROPOSED SOLE SOURCE PROCUREMENT

REQUEST FOR INFORMATION (RFI)

SALT LAKE COUNTY

Notice #: ART128962

The Division of Contracts and Procurement has received a request to purchase from a “sole source” vendor. If, for any reason, any party does not agree that this sole source purchase is applicable, please email the contact person for Salt Lake County Contracts and Procurement Division prior to the “Comments Due Date:” indicated below:

Title: Gallery 3 Chairs for Hussey Seatway Platform

SOLE SOURCE JUSTIFICATION

Sole source procurement is appropriate when goods or services are only available from a single vendor; when the most important consideration is the standardization or compatibility of equipment, materials, technology, software accessories, replacement parts, or service; where transitional costs are unreasonable or cost prohibitive; or if it otherwise qualifies under County Ordinance 3.20.030.

The services requested under this procurement are a continuation of a competitively bid contract that had been awarded for the construction of the Eccles Black Box Theater.

The current request is a standardization request to provide a bleacher chair addition to the Eccles Black Box Theater. This addition is to include Gallery 3 Chairs by Hussey Seatway, labor, and parts necessary to complete the project.

This product is only available from a single supplier, because it is proprietary to the manufacturer. The chairs must be sourced from this vendor, as they are the only ones compatible with the proprietary railing-mounted seating support system currently installed.

Chairs from other manufacturers would not properly fit or safely integrate with the Black Box Theater’s existing system and would require modification or replacement of the railing-mounted seating support system. This modification or replacement would result in additional costs, delays, and potential safety or code-compliance issues. After careful review, there appear to be no other suppliers that offer compatible products.

Norcon Industries, Inc. is the only source capable of providing, installing, and maintaining the proprietary materials required to ensure a seamless match with the current platform.

Proposed Standardization Provider: Norcon Industries, Inc.
