The project encompasses pavement rehabilitation and overlay work on Arnot Road from I-40 East Frontage Road to approximately 2,350 feet south in Potter County. The work includes demolition of existing pavement, excavation and grading, placement of flexible base material, installation of vehicular concrete pavement and flatwork, asphalt milling where applicable, tack coat application, hot mix asphalt concrete overlay placement, curb and gutter construction, pavement markings, and traffic control measures. Sealed proposals were due by 10:00 AM on June 3, 2026, with public opening scheduled for 10:30 AM the same day. A mandatory pre-bid walkthrough was conducted on May 20, 2026, at 10:00 AM. The bid form includes both a Base Bid for full concrete pavement and curb/gutter work and an Alternate Bid for asphalt milling and hot mix overlay treatments, with bidders required to specify construction completion timelines in calendar days for each option.

The contract award will be determined using a 100-point scoring system: 50 points for lowest proposed price, 20 points for proposed calendar days to completion, 10 points for experience of key personnel and subcontractors, 10 points for history of on-time project completion within the past five years, and 10 points for past relationship with the county. A 5 percent bid bond is required with proposal submission, and the successful bidder must furnish a 100 percent Performance and Payment Bond within 10 days of award. The contract allows Potter County to increase or decrease the contract amount by up to 25 percent and adjust quantities as necessary to meet budget constraints. Payment will be made 30 days after invoice receipt upon satisfactory completion of work, with retainage withheld as specified in supplementary conditions. The project is subject to prevailing wage requirements per Texas Department of Labor wage determinations, with rates ranging from $13.50 to $27.08 per hour depending on classification. Liquidated damages are assessed at $500 per day for failure to meet the completion schedule. All work must comply with applicable federal, state, and local laws, environmental regulations, and safety standards including OSHA requirements and erosion control measures.

00 21 16 - 4

15.00 UNIT PRICES AND EXTENSIONS

In case of an error in multiplication of a quantity and unit price proposed for any item in the Bid, resulting in an erroneous total amount proposed for the item, the unit price will be considered as the proposed price, and will be used in comparison of bids and for payment in the event the Bid is that of the successful Bidder. Unreasonable or unbalanced unit prices may be cause for rejection of a bid.

16.00 AWARD OF CONTRACT

16.01 Owner reserves the right to reject any and all Bids and waive any and all formalities, and the right to disregard all nonconforming or conditional Bids or counter informalities.

16.02 In evaluating Bids, the total points to be awarded to all criteria when selecting or awarding a contract will be 100 points collectively. The maximum number of points per criteria will be as follows:

1. 50 pts the proposed price

(Lowest Price/Current Bid Price) x Maximum Point Value = Price Score;

2. 20 pts the proposed calendar days for construction

3. 10 pts the experience of key personnel and subcontractors;

4. 10 pts history of completion of project on time in the past five years;

5. 10 pts the vendor’s past relationship with the county;

16.03 In evaluating the above criteria, the owner will consider the qualifications of the Bidders, whether or not the Bids comply with the prescribed requirements, time of completion, and alternates and unit prices if requested in the Bid forms. The owner will consider the qualifications and experience of Subcontractors and other persons and organizations (including those who are to furnish the principal items of material or equipment) proposed for those portions of the work as to which the identity of Subcontractors and other persons and organizations must be submitted as specified in the bid documents.

The owner may conduct such investigations as he deems necessary to establish the responsibility, qualifications and financial ability of the Bidders, proposed Subcontractors and other persons and organizations to do the work in accordance with the Contract Documents to Owner's satisfaction within the prescribed time. Owner reserves the right to reject the Bid of any Bidder who does not meet any such evaluation to Owner's satisfaction.

16.04 If a contract is to be awarded, it will be awarded to the lowest responsible Bidder or Bidders whose evaluation by Owner indicates to the Owner that the award will be in the best interest of the Project.

16.05 It is expected that the Owner's evaluation of bids and award of contract or contracts will be made as set forth in the Legal Notice. Time of completion is important and failure to meet completion schedule will subject the Contractor to liquidated damages as provided for in the Contract Documents.

00 21 16 - 5

17.00 EXECUTION OF CONTRACT

17.01 The accepted Bidder, within fifteen days after formal notice of award, shall execute the formal Contract Agreement and required Bonds on the forms prepared and submitted by the Owner.

The Owner reserves the right to adjust the number of quantities in order to meet budget restraints. The total may be adjusted either by adding or deleting roads.
