About this file
This is a Claim of Business Confidentiality Form issued by the State of Utah for the UDOT IFB – Mobile Crane Operator, Digger Derrick, Service Truck Crane, Boom Truck Operator, Signalperson, Rigger, and Overhead Crane Training, Testing, and Certification solicitation. The form allows bidders to claim business confidentiality protection for specific information submitted as part of their proposals, in accordance with Utah Code Annotated Subsections 63G-2-305(1) and (2) and Section 63G-2-309. Bidders may claim confidentiality for non-public financial statements, specific employee names and contact information, customer or client lists, and other proprietary information that qualifies as a trade secret or commercial information. The form requires bidders to specify which pages and paragraphs of their proposals contain confidential information and to provide detailed reasons for the claim based on the applicable statutory definitions.
Pricing and cost proposals are explicitly excluded from confidentiality protection and will be considered public information. Bidders may not classify their entire proposal as "PROTECTED," "CONFIDENTIAL," or "PROPRIETARY." Information claimed as confidential must meet the statutory definition of a trade secret—information that derives independent economic value from not being generally known and is subject to reasonable efforts to maintain secrecy—or qualify as commercial information where disclosure could result in unfair competitive injury or impair the governmental entity's ability to obtain necessary information in the future. Bidders will be notified if the State determines that claimed confidential records should be classified as public or released after weighing the relevant interests under Utah Code Annotated provisions.
