APPLICABLE REGULATIONS GOVERNING PROCUREMENT
All applicable Nevada Revised Statutes (NRS) and Nevada Administrative Code (NAC) documentation can be found at: www.leg.state.nv.us/law1.cfm.
Prospective vendors are advised to review Nevada’s ethical standards requirements, including but not limited to NRS 281A, NRS 333.800, and NAC 333.155.
PROJECT OVERVIEW
The State of Nevada Purchasing Division, on behalf of the Department of Administration’s Risk Management Division is seeking proposals that identify insurance brokers with the appropriate qualifications and experience to assist the Risk Management Division in marketing and structuring its Workers’ Compensation Insurance Program pursuant to NRS 331.184(3) as described in the Request for Qualifications (refer to Section 3) and attachments.
The State intends to establish a small pool of qualified brokers, minimum of two (2) and maximum of five (5) for this purpose. Although up to five (5) brokers may be selected, the Risk Management Division is not obligated to select a specific number of brokers for this purpose. The Risk Management Division will manage any contracts resulting from this Request for Qualifications.
The awarded brokers will be eligible to solicit insurance policy quotes, assist in the development of RFP’s for a variety of unbundled program services such as Claims Administration, Managed Care, Loss Control, Safety Training, Captive Management etc., provide oversight and monitoring of awarded contracts, and provide recommendations regarding program structure at the request of the Risk Manager. Insurance quotations and recommendations may be under varied plans, to include self-insurance.
The State implements a comprehensive Safety/Return to Work Program Report and assistance in the monitoring and development of enhancements to this program may be included as service requests.
Insurance quotations received by the Risk Manager will not be subject to competitive selection.
Use of the broker pool will be at the Risk Manager’s discretion. It is possible that a broker who is selected for inclusion in the broker pool will not be asked to submit insurance response quotes or to provide available services.
The Risk Manager reserves the right to reject any or all responses and purchase insurance directly from an insurer or its agents, without the use of broker services.
The Nevada System of Higher Education (NSHE) may also solicit insurance policy quotes specific to the colleges and universities needs and access related services from brokers selected for this pool.
Brokers may talk to markets on a conceptual basis. A broker’s discussions with a market must not block that market from working with another broker if assigned. Blocking markets will be grounds for disqualifying your firm from further consideration and/or could result in a termination of your contract.
The Risk Manager will assign markets if more than one broker is asked to obtain policy quotes in any given policy period. In this situation, every effort will be given to assign the broker their first-choice preference.
Generally, insurance markets will be assigned as requested by the broker. However, if more than one (1) broker requests the same market, the broker that has the higher premium volume with the requested market, at the time, will be assigned the market. If premium share is relatively equal, market assignments will be determined by lottery. This process, if necessary, will be witnessed by a representative from the State Purchasing Division.
The Risk Management Division may request access to any number of available workers’ compensation services from the firms selected for the broker pool that are available on a fee basis, within budgetary allocations, for the term of the contract or any given policy year within the contract period.
The State’s current program is a large deductible fully insured plan ($2,000,000 per occurrence) that includes police/fire and road construction/maintenance exposure.
Multi-year programs are desirable for the benefit of cost stability during the biennial budget cycle.
The State intends to award multiple contracts in conjunction with this Request for Qualifications (RFQ), as determined in the best interests of the State. The Risk Management Division shall administer the contract(s) resulting from this RFQ. The resulting contract(s) are expected to be for a contract term of five years, anticipated to begin on July 1, 2023, subject to Board of Examiners approval.
AGENCY BACKGROUND
The mission of Risk Management is to preserve and protect State property and personnel. This is achieved by integrating agency programs that systematically identify and analyze exposures to risk, selecting and implementing appropriate risk control strategies, financing anticipated or incurred losses and regular monitoring for continual improvement and enhancement. Please see attachments in section 5.1.2 through 5.1.6 for an overview of the States Workers’ Compensation Program.

The State applies an inverse preference to vendors that have a principal place of business in a state other than Nevada and that state applies an in-state preference not afforded to Nevada based vendors, pursuant to AB28 passed in the 81st session of the Nevada Legislature.
The amount of the inverse preference is correlated to the amount of preference applied in the other state.
Vendors who meet this criterion must indicated it on their submitted Quote in NevadaEPro.
This preference cannot be combined with any other preference, granted for the award of a contract using federal funds, or granted for the award of a contract procured on a multi-state basis.

Contractor’s obligation to indemnify the State shall apply in all cases except for claims arising solely from the State’s own negligence or willful misconduct. Contractor waives any rights of subrogation against the State. Contractor’s duty to defend begins when the State requests defense of any claim arising from this Contract."
LIMITED LIABILITY. Required contract terms on Limited Liability: "The State will not waive and intends to assert available NRS Chapter 41 liability limitations in all cases. Contract liability of both parties shall not be subject to punitive damages. Damages for any State breach shall never exceed the amount of funds appropriated for payment under this Contract, but not yet paid to Contractor, for the Fiscal Year budget in existence at the time of the breach.
