Equal Benefits Ordinance Disclosure Form Summary
This document is an Equal Benefits Ordinance (EBO) Disclosure Form and Certification of Compliance issued by the City of Long Beach for contractors and vendors seeking to enter into contracts with the municipality. The form establishes requirements for employee benefits nondiscrimination as a condition of contract award. The EBO applies to for-profit employers with City contracts valued at $100,000 or more for goods, services, public works, improvements, or construction projects, and to for-profit entities generating $350,000 or more in annual gross receipts from leasing City property under written agreements exceeding 29 days in any calendar year. Contractors subject to the EBO must complete the EBO Certification Form and obtain either compliance certification or an approved waiver from the City before contract execution. The ordinance permits contractors to delay implementation of compliance procedures under specific circumstances: by the first effective date after the first open enrollment following contract start, not exceeding two years if reasonable compliance measures are documented; within three months for administrative infrastructure changes; or upon expiration of current collective bargaining agreements.
Contractors must certify compliance with Long Beach Municipal Code section 2.73 and agree to provide equal benefits to employees with spouses and domestic partners, including health insurance, bereavement leave, family medical leave, membership discounts, moving expenses, retirement benefits, and travel benefits. Failure to comply with the EBO after exhausting permissible delay periods constitutes material breach, subjecting the contractor to contract cancellation, termination, suspension, disqualification from City contracting for three years, assessment of liquidated damages, and pursuit of additional legal remedies. The form requires certification under penalty of perjury and mandates that the City be permitted access to records for compliance verification.
