About this file

This document is a Questions and Answers (Q&A) file for a Debt Collection Services procurement by the State of Nevada's State Controller's Office (SCO). The solicitation seeks collection agency services for various state agency receivables, with a bid opening date of 9/16/2025. The SCO does not have a specific target number of vendors and will consider all qualified vendors. The scope includes collecting on diverse debt types such as tuition fees, administrative fines, permits, application fees, inspection fees, supervision fees, health insurance premiums, business license fees, payroll overpayments, NSF checks, and taxes.

The current contract environment involves three incumbent collection vendors: General Revenue Corporation, Penn Credit Corporation, and Transworld System Incorporated. The state has approximately $1 billion in delinquent debt, with about 59% of accounts being business-related and the remainder individual accounts. The contingency fee rates for collection services currently range from 12% to 35%. Vendors will be expected to use their own collection platforms, potentially perform legal actions, and work with the SCO to develop a performance plan. The state allows digital communication methods like email and text, and permits installation payment plans and settlements. Approximately 12% of accounts have email addresses, and vendors are encouraged to propose comprehensive collection strategies that might include forensic accounting services.

7 What has been the historical rate of return or liquidation rate provided by any incumbent(s), and/or what is anticipated or expected as a result of this procurement?

The table below (SA=State Agency) shows the percentage of liquidity on accounts with payments only. The State is always looking for ways to improve collections on the money owed to the State of Nevada.

8 What billing servicer do you utilize? Each State Agency has its own internal procedures to collect its receivables before the account is referred to the SCO for collection. The SCO doesn't have the details of those collection attempts.

9 Have all cases been fully adjudicated by the time of placement? No.

10 If applicable, will accounts held by any incumbent(s) or any backlog be moved to any new vendor(s) as a one-time placement at contract start up?

06CO-S3440 Debt Collection Services Bid Q&A

Are bidders permitted to deviate in any way from any manner of quoting fees you may be expecting? For example, if there is a pricing page in the RFP, can bidders submit an alternate fee structure? If there is no pricing page in the RFP, do you have any preference for how bidders should quote fees or can bidders create their own pricing categories?

Please fill out the attached cost schedule that was provided. You can add any additional information if needed but the aqency may not accept those terms.

18 Please describe your level of satisfaction with your current or recent vendor(s) for the same purchasing activity, if applicable.

The State appreciates the contributions of past vendors but is always looking for ways to improve collections on the money owed to the State of Nevada.

19 Do any of the accounts being placed for collection include any FTI? See Scope of Work section 1.1. It is possible that some agencies may include this type of receivable.

20 What identifiers (SSN, DOB, address, phone, employer info) will be provided? The SCO will provide as much information as possible on the debtor (s). SCO will not refer accounts to collection agencies that do not have either an address or an SSN.

QUESTION_NBR QUESTION_TEXT ANSWER_TEXT

21 How often will placements occur (daily, weekly, monthly)? SCO receives placements daily, weekly and monthly accounts from the state agencies. However, SCO refers accounts to Private Collection agencies in a monthly basis.

22 What mix of debt types is expected (consumer fines, taxes, fees, NSF checks, employee debts, business/commercial receivables)

See Scope of Work 1.1. Types of receivables include but are not limited to Tuition Fees, Administrative Fines, Assessments, Permits, Application Fees, Inspection Fees, Supervision Fees, Health Insurance Premiums, Business Licenses Fees, Payroll Overpayments, NSF Checks, and Taxes.

23 Will the State segment by age/size of debt (e.g., fresh vs. secondary placements, <$100 vs.

>$10K)?

If the vendor is interested in accepting secondary or tertiary placements the vendor may want to include fee proposals for these placements in their response.

24 What is the projected number of accounts per year (beyond the 7,500 referred in 2024) This information is unknown at this time. It depends on the accounts placed by the State agencies.

If our registered sam.gov name does not match our State of Nevada Business license, (i.e. our business name was not available in the State of Nevada so we were required to add an additional identifier) can we provide our sam.gov unique id instead of changing either name to be identical?

The name must match the Business Licence or the DBA with the Secretary of the State.

26 How will accounts be transmitted? Will the State be using their own SFTP or using the vendors? The SCO uses the Secured File Transfer Protocol (SFTP) to send and receive files.

27 Are you utilizing APIs for file transfers? Please see response to Question No. 26

28 Will the state authorize vendors who are capable of performing a tax intercept to do so? Yes

In the SOW it says "If the vendor is not authorized to litigate, it must return accounts that warrant further legal action to the Controllerâ??s Office, with a detailed explanation" What requirements must be met in order to be able to litigate, and will the State still require a request to authorize legal action on a per case basis?

The State expects the vendors to file lawsuits if they find debtor assets. Prospective vendors may want to specify in their responses to the RFP what criteria they would use to determine when to initiate legal action against debtors.

30 Can the State provide historical placement volumes broken down by agency, debt type, or dollar range?

The number of accounts placed to the vendors depends on the placements received from the State agencies. As a today's date we placed more than 100,000. accounts to the vendors.

31 Will vendors receive accounts at both primary and secondary placement levels? If so, how are placements prioritized?

The State’s current practice is to send similar number of accounts randomly to each vendor. However, there may be instances where it is in the best interest of the State to assign a particular state agency’s accounts to a single vendor and make other adjustments as needed.

32 How will accounts be prioritized (e.g., by age, dollar amount, agency)? No.

33 What is the expected timeline for the first collection activity after referral beyond the two-contact minimum?

The SCO will work with the selected vendor(s) and provide the file layouts. It depends when the selected vendor will have ready its platform to receive placements from SCO.

34 Will the vendorâ??s designated attorney be responsible for handling all litigation, or only escalation cases approved by the Controllerâ??s Office?

The State expects the vendors to file lawsuits if they find debtor assets. Prospective vendors may want to specify in their responses to the RFQ what criteria they would use to determine when to initiate legal action against debtors.

35 Please provide the percent of accounts that have an email address. Approximately 12% of the accounts.

36 What are your current pain points as it relates to your current collection process? The SCO and selected vendor will jointly develop a Performance Plan.

41 The RFP states that there is a backlog of approximately $1 billion. Can you provide a breakdown by debt type and the amount of each backlog?

RFP, section 2.4.2 states that, the State of Nevada has an approximate $1 billion dollars in delinquent debt. The backdown of the debt type is not available. State Agencies do not share that information with SCO.

QUESTION_NBR QUESTION_TEXT ANSWER_TEXT

42 Can the state provide a % breakdown of placements each current vendor receives? Please see response to Question No. 30

43 What are your organizationâ??s recall parameters (e.g., accounts recalled 180 days post-account assignment with no payment received in the last 90 days)?

We don't have specific time frames. There may be instances where it is in the best interest of the State to recall an account and re-assign it to a particular vendor.

44 What is the average age of accounts that will be assigned for collection (by account type)?

The State strives to place accounts with vendors as soon as possible, but it is not uncommon to periodically have various funds several years old, or older. It is unknown at this time the average age of the accounts that will be placed for collections in the future, but the State will attempt to reduce placement time as much as possible.

45 After the initial account placement, will collection vendors be assigned â??future flowâ?? account placements (perhaps based on their competitive performance)? Please see response to Question No. 31

46 On average, how much do your current vendors collect monthly (expressed as dollars recovered and liquidation rate)? Please see response to Question No. 40

55 How often will accounts be assigned with the vendor(s) (e.g., daily, weekly, monthly, quarterly)? Please see response to Question No. 21

56 Will account volume assigned to your incumbent collection vendor(s) be recalled and reassigned to the winning bidder(s)?

Yes, this is a new procurement. If a current vendor is not awarded under the new contract, then their outstanding accounts will be recalled and referred to a new vendor. If the vendor is interested in accepting secondary placements (those from previous vendors) then may want to include fee proposals for these placements in their response.

57 How long will account volume be retained (prior to recall) with the winning bidder(s)?

The current contracts expire on December 31,2025. If the new contract(s) are approved by the Board of Examiners before December 31, 2025 then we may be running simultaneously with new vendor contracts. This will avoid interruption to the State’s debt collection efforts while new vendors work with the SCO to implement the system necessary to receive debt referrals from the State.

58 Will the winning vendor(s) receive account placements that were previously assigned with your incumbent collection agencies? Please see response to Question No. 56

59 On average, how many accounts (expressed as number and dollar amount) do you anticipate placing with the successful vendor monthly? This information is unknown at this time. It depends on the accounts placed by the State agencies.

60 Require Vendor Information Response â?? Form includes only 1 page, but the page is numbered as Page 1 of 4. Please confirm this is a one-page form Confirmed, only one page exists

63 Is there a testing plan in place for account transmission? Yes

64 Do you have a data processing file schedule? Yes

65 What are the roles of the individuals who comprise the evaluation committee? Information requested does not materially impact the venodrs ability to respond. The state does not disclose evaluation information until after release of the Formal Notice of Award.

66 What is the reconciliation process for this project? All communication with the vendor(s) is made by the SCO. CA’s will not be communicating directly with the Agencies. For security reasons, access to the State’s system would not be permitted.

67 What debtor information will be provided (e.g., SSN, telephone, address, amount owed)? Please see response to Question No. 20

68 What are the fee rates of your incumbent collection vendor(s)? How are the fees calculated? Please see response to Question No.1. Cost Schedule Attachment, Table No. 3 and 4 illustrates the calculation.

69 Does the contract require any special handling of debtor correspondence? No.

70 How are balances updated on the vendorâ??s system? Do you provide a daily update of the entire inventory? The SCO sends CAU form to the awarded vendor(s) weekly. This form includes updates to the account.

71 What are your target or anticipated fee rates for this contract? Cost Schedule Attachment, Table No. 1 includes the rates limits under this RFP.

72 Will the winning collection vendor(s) use its own collection platform, or will a preferred platform be provided? Awarded vendor will use its own platform.

73 Is training considered billable? Yes.

74 Does the client have any existing training material or resources to share upon award? Yes.

The RFP states that for debts in excess of $300, costs and fees up to 35% of the debt principal (or $50,000, whichever is less) may be assessed, and that the 2% Controllerâ??s Office fee is included within this 35% statutory maximum. Based on this language, our understanding is that fees are calculated strictly on the principal amount of the debt.

Could you clarify how this applies in cases where the outstanding balance has been reduced to amounts other than principal (e.g., interest, penalties, or miscellaneous fees)?

This clarification is important for us to fully understand how agency compensation is determined, particularly in light of NRS 649.334(2), which requires payments to be applied to principal first unless otherwise provided in a written agreement.

Cost Schedule Attachment has the description of the "Amount Demanded" Pursuant to NRS 353C.135(1)(a), for debts in excess of $300, the debtor is required to pay costs and fees incurred to collect the debt in addition to the principal amount of debt owed to the State. This is the total amount of money owed by the debtor after adding the State Controller’s Office (SCO) Fee and the Collection Fee to the Amount Placed. If the amount is reduced, then the fees are recalculated based on the new balance. See Cost Schedule Attachment to illustrate the fee calculation. See table 3 and 4.

Since the RFP indicates collection costs are added to accounts over $300, will SCO consider implementing a standardized fee structure for all collection vendors? A uniform fee structure helps mitigate the risk of perceived unfair or discriminatory practices (UDAAP concerns), such as when one debtor is charged a higher collection fee by Agency A while another is charged a lower fee by Agency Bâ??despite having no control over which agency handles their account.

See Cost Schedule Attachment illustrates the fee calculation. The SCO follows the NRS 353C.135. Vendors are encouraged to submit their fee proposal to this RFP.

"1.13.21 The vendor is allowed to receive a collection fee on the amount collected if Controllerâ??s Office, or other state agency receive a payment from the debtor after the account was referred to the vendor for collections. However, no fees will be paid to the vendor if the Controllerâ??s Office does not receive an invoice from the vendor after (90) days of receiving notification of the payment." How are vendors notified of payments received by the Controllerâ??s Office (or other state agency) directly?

Only the SCO sends weekly notifications to the vendors. Additionally, a monthly statement that includes all these payments are sent to the vendor(s)

QUESTION_NBR QUESTION_TEXT ANSWER_TEXT

"1.14.8. Vendors shall be prepared to travel wherever necessary in order to maximize recovery of the governmentâ??s receivables."

Under what circumstances do you envision vendors traveling to support recovery efforts?

Vendors may want to specify in their responses to the RFP what criteria they would use to support recovery efforts.

"1.14.11 Vendors and their subcontractors shall be responsible for all administrative costs related to filing judgments, bankruptcy claims, liens, garnishments, bank attachment filings, and attachable assets."

What is vendor involvement is expected with regard to bankruptcy claims?

The vendor will notify the SCO about the bankruptcy claim so we will close the account due to bankruptcy.

81 Please confirm our understanding that the implementation plan will be determined cooperatively following award and need not be submitted with our proposal.

It is correct. SOW, section 1.14.12. Vendors shall meet with the Controller’s Office within thirty (30) days of contract approval.

The purpose of the meeting will be to establish an Implementation Plan.

"1.14.15. Vendor shall testify upon request by the State at court proceedings in conjunction with the recovery action, or on behalf of certain legislation related to receivable recoveries."

How often are vendors called upon to testify and are vendors expected to appear in person or virtually?

Not very often. So far we had this situation only once.

"1.15.2 Inbound Statement â??CS1â??. This report includes only payments received by the vendor. The report and funds must be received by the Controllerâ??s Office the same day the ACH is transferred to our office. The ACH payment must match the statement."

What is the desired frequency/schedule for the CS1 report and accompanying ACH remittance?

(E.g., monthly, weekly, daily, etc.)

Monthly.

Question #1.13.29. may be missing part of the question. It ends at "but are not limited to,"

Vendors are expected to reimburse the Controllerâ??s Office for any amount that becomes uncollectible which is lost due to any act or omission of the vendor or its officers, agents, or employees. Such acts or omissions may include, but are not limited to, Please provide the remainder of the question.

SOW, section 1.13.29. Vendors are expected to reimburse the Controller’s Office for any amount that becomes uncollectible which is lost due to any act or omission of the vendor or its officers, agents, or employees. Such acts or omissions may include, but are not limited to,

1.13.30. Accepting a compromise settlement for less than the total amount due without authorization of the Controller’s Office and the state agency and acknowledging that a payment constitutes payment in full when in fact the debt or account is not paid in full.

1.13.31. Adjust the principal amount of the claim if the Controller’s Office later revises the amount of the claim. The contingent fee collection amount charged will be calculated on the revised amount of the claim.

85 These are duplicate questions. N/A

The State has requested that confidential business information be submitted in separate files and flagged as confidential in NevadaEPro. Could you please clarify:

How do we flag information as confidential within the NevadaEPro portal?

Is naming the file â??Confidentialâ?? sufficient, or is there an additional step required in the system?
