About this file

This is a Statement of Work for Request for Proposal No. 240000002338 issued by the Michigan Department of Environment, Great Lakes, and Energy (EGLE) for an Electronic Document Management (EDM) Scanning Project. The project requires the contractor to provide 35-40 full-time professionals to review, convert, and index historical paper files and incoming mail into electronic format across multiple EGLE district offices located in Kalamazoo, Cadillac, Grand Rapids, Jackson, Bay City, and Warren. The scope involves sorting documents chronologically, eliminating duplicates and expired records, converting paper files to PDF format with appropriate redaction of personally identifiable information (PII), and indexing documents into the Content Manager system according to division naming conventions and retention schedules. Professionals must possess at least an associate degree in sciences (preferably environmental), demonstrate strong organizational and computer skills, and commit to at least one year of employment. The contract has a five-year base period with work hours Monday through Friday from 7:30 a.m. to 6:00 p.m. EST, and the State will provide 120 days' notice if the project reaches completion before the contract term ends.

Pricing is firm for the five-year base period with adjustments possible at the start of each option year based on documented changes in actual contractor costs, supported by evidence such as the Consumer Price Index or Producer Price Index. The contractor must submit monthly invoices by the 15th of each month via email, including detailed labor information, hourly rates, hours worked, and monthly progress reports. Payment will be made via Electronic Funds Transfer (EFT). If the contractor utilizes subcontractors for more than 20 percent of deliverables, at least 20 percent of subcontracted work must be awarded to Michigan-based Geographically Disadvantaged Business Enterprises (GDBEs), or the contractor must provide justification for an exemption. Service level agreements establish performance metrics agreed upon by both parties prior to work commencement, with potential invoice credits of 5-10 percent assessed for non-compliance with reporting deadlines and performance outcomes. Liquidated damages of $5,000 plus $100 per day apply for late or improper completion, and unauthorized removal of key personnel may result in credits up to $50,000 per individual.

SCHEDULE A – STATEMENT OF WORK CONTRACT ACTIVITIES

Request for Proposal No. 240000002338 Electronic Document Management (EDM) Scanning Project This schedule identifies the anticipated requirements of any Contract resulting from this RFP. The term “Contractor” in this document refers to a bidder responding to this RFP, as well as the Contractor who is awarded the contract. The term “Bidder” is used to identify where specific responses to the RFP are required.

The Contractor must respond to each requirement or question and explain how it will fulfill each requirement. Attach any supplemental information and appropriately reference within your response.

IMPORTANT NOTE TO CONTRACTORS/BIDDERS: There are specific requirements for which acceptance must be simply acknowledged through a checkbox(es), and others that require further explanation. Click the appropriate checkbox and complete the entries as appropriate.

BACKGROUND

The Department of Environment, Great Lakes, and Energy (EGLE) works with the public and businesses to achieve and maintain compliance with the permits and regulations, public drinking water supplies and monitoring, supports household hazardous waste recycling programs, along with Radon testing, and manages environmentally contaminated properties. Management of the properties requires significant documentation of all activities performed to investigate the presence of contaminants, of the risks from the hazardous substances to public health and the environment, of the actions taken to mitigate those risks, and of the redevelopment of these properties. Department documentation consists of highly technical reports detailing the scientific information gathered to support decisions regarding risks, need for remediation, and requirements for protecting people while redeveloping properties. These documents include, but are not limited to environmental reports, environmental laboratory data, email and telephone correspondence, environmental decisions relating to previous and future actions, PEAS documentation, incident reports, public comments, public presentations, legal documentation for businesses and properties, legislative orders, laws and regulations, videos, and publications. EGLE is coordinating an effort to improve the electronic accessibility of this scientific documentation to improve the department’s processes for managing the programs as well as increasing the transparency of the documentation for the public. This effort requires the implementation of digital document management and cross-referencing with publicly available data resources.

SCOPE

To achieve this effort, EGLE requires technical support from professionals skilled in understanding the industry-specific environmental documents to continue review of the remaining files in the sections and district offices along with the Department of Technology, Management and Budget’s Records Center to identify documents in the more than 20,000 boxes that are considered necessary and official records of the state per the requirements of the department. The project will continue until all section and district files have been reviewed, converted, and entered in Content Manager (CM). When official records are identified and matched to their appropriate file and the scientific data is verified and updated as needed, the technical support professional working in the district office will coordinate with division staff and be tasked with converting the paper records to an electronic format.

The State will provide the Contractor 120 days’ notice if during the Contract period the project reaches completion (all files have been reviewed, converted and entered into Content Manager) and the Contractor’s services are no longer needed.

1. Requirements

1.1. General Requirements

The Contractor must recruit professionals who are able to perform the following Electronic Document Management (EDM) process from beginning to the final quality assurance, quality control process (QA/QC).

EDM Process:

· Obtain the paper or electronic site file from the district office.

· Sort the documents by chronological order looking at:

1. Checking division and department databases for site information and if the site is on litigation hold.

2. Review the site documentation to eliminate any documents that have met our retention period. Keeping in mind the litigation hold status. Remove them as needed.

3. Look for duplicate copies of reports, lab data, correspondence, permits, legal documents, invoices, etc. to eliminate from the site file.

4. Review Content Manager to see if documents exist for the site to compare against the paper site file. Compare documents to see which is the complete one. Remove duplicates from site file.

5. If the site is on litigation hold, we keep all the documents in the site file and convert them to an electronic format keeping the removed documents separate from the rest of the site file to process differently.

· Convert the documents into the Portable Document Format (PDF) document by document reviewing each one for:

1. Document page order.

2. Page rotation.

3. Color, Greyscale and Black and White pages.

4. Large format maps.

5. Look for and redact Personally Identifiable Information (PII).

6. Name documents following division naming conventions. Create two documents, a redacted and non-redacted version if needed.

7. Place converted documents into the record center box when completed.

8. Track progress on division trackers.

9. Take completed boxes to the QA/QC team to be reviewed.

· Search for site in Content Manager, verify that it is the correct site using the divisions Remediation Information Data Exchange (RIDE) database.

· Update content manager site information to match the RIDE database and apply to all site folders.

· Create the necessary folders in content manager for the documents to be indexed into the system applying the appropriate retention schedule and security to the folders.

· Index documents into the appropriate folders following the naming convention for each document.

· Remove document duplicates as the replacement is indexed.

· Track progress on division trackers.

· Repeat process.

· Make corrections to documents indexed into content manager as identified by the QA/QC team.

Additional job duties:

· Support Freedom of Information Act (FOIA) program requests.

· Attend staff meetings.

· Attend training sessions.

To ensure accuracy of the replication of the official record, a rigorous quality assurance/quality control process will be employed to verify the accuracy of the conversion by professionals located in the Kalamazoo, Cadillac, Grand Rapids, Jackson, Bay City and Warren offices. These professionals are also tasked with identifying the document and following the appropriate naming convention for each document and archiving the document in the electronic system and/or completing the final quality assurance/quality control of the electronic document against the paper file before the paper files are sent for destruction. To address the historical paper files within EGLE based upon Executive approved timelines, the Contractor must provide 35-40 full-time professionals to provide services in the various EGLE district offices as required.

Similar procedures exist for handling incoming EGLE mail and subsequent scanning requirements. Professional resources are tasked with working as part of the mail scanning operation team to complete those duties. Additionally, on an as-needed basis, resources may be required to handle scanning processes for other areas of the department under direction of EGLE’s Information Management Division (IMD) and RRD. The professionals will work within the guidelines developed by the Electronic Records Unit (ERU) within Information Management Section (IMS) of RRD and overseen by unit staff experienced in the maintenance of the official record. This oversite will consist of daily tracking database checks against actual electronic format documents performed by ERU staff to ensure accuracy of product, adherence to procedures and anticipated time schedules.

The technical professionals will participate in status meetings and routine updates with RRD IMS staff and discuss the metrics generated by ERU and project progress.

2.4. Key Personnel

The Contractor must appoint an individual who will be directly responsible for the day-to-day operations of the Contract (“Key Personnel”). Key Personnel must be specifically assigned to the State account, be knowledgeable on the contractual requirements, and respond to State inquiries within 24 hours.

The State has the right to recommend and approve in writing the initial assignment, as well as any proposed reassignment or replacement, of any Key Personnel. Before assigning an individual to any Key Personnel position, Contractor will notify the State of the proposed assignment, introduce the individual to the State’s Project Manager, and provide the State with a resume and any other information about the individual reasonably requested by the State. The State reserves the right to interview the individual before granting written approval. In the event the State finds a proposed individual unacceptable, the State will provide a written explanation including reasonable detail outlining the reasons for the rejection. The State may require a 30-calendar day training period for replacement personnel.

Contractor will not remove any Key Personnel from their assigned roles on this Contract without the prior written consent of the State. The Contractor’s removal of Key Personnel without the prior written consent of the State is an unauthorized removal (“Unauthorized Removal”). An Unauthorized Removal does not include replacing Key Personnel for reasons beyond the reasonable control of Contractor, including illness, disability, leave of absence, personal emergency circumstances, resignation, or for cause termination of the Key Personnel’s employment. Any Unauthorized Removal may be considered by the State to be a material breach of this Contract, in respect of which the State may elect to terminate this Contract for cause under the Termination for Cause section of the Standard Contract Terms. It is further acknowledged that an Unauthorized Removal will interfere with the timely and proper completion of this Contract, to the loss and damage of the State, and that it would be impracticable and extremely difficult to fix the actual damage sustained by the State as a result of any Unauthorized Removal. Therefore, Contractor and the State agree that in the case of any Unauthorized Removal in respect of which the State does not elect to exercise its rights under Termination for Cause, Contractor will issue to the State the corresponding credits set forth below (each, an “Unauthorized Removal Credit”):

i. For the Unauthorized Removal of any Key Personnel designated in the applicable Statement of Work, the credit amount will be $25,000.00 per individual if Contractor identifies a replacement approved by the State and assigns the replacement to shadow the Key Personnel who is leaving for a period of at least 30-calendar days before the Key Personnel’s removal.

ii. If Contractor fails to assign a replacement to shadow the removed Key Personnel for at least 30-calendar days, in addition to the $25,000.00 credit specified above, Contractor will credit the State $833.33 per calendar day for each day of the 30-calendar day shadow period that the replacement Key Personnel does not shadow the removed Key Personnel, up to $25,000.00 maximum per individual. The total Unauthorized Removal Credits that may be assessed per Unauthorized Removal and failure to provide 30-calendar days of shadowing will not exceed $50,000.00 per individual.

Contractor acknowledges and agrees that each of the Unauthorized Removal Credits assessed above: (i) is a reasonable estimate of and compensation for the anticipated or actual harm to the State that may arise from the Unauthorized Removal, which would be impossible or very difficult to accurately estimate; and (ii) may, at the State’s option, be credited or set off against any fees or other charges payable to Contractor under this Contract.

The Contractor must identify the Key Personnel, indicate where they will be physically located, describe the functions they will perform, and provide current chronological résumés.
