3. Section C - Description/Specifications/Work Statement

QCIM Shelving Supply & Installation Scope of Work (SOW)

Background:

• The U.S Government Publishing Office (GPO) provides publishing and dissemination services for the official and authentic government publications to Congress, Federal agencies, Federal depository libraries, and the American public.

• Inventory Management is responsible for properly handling and keeping record of GPO’s physical stock.

However, their outdated carousels are proven cost and space inefficient with their current operations. Agency Support Operations request that the carousels be replaced with shelving that better suits daily processes.

• The Contractor shall provide all labor, materials, equipment, transportation, supervision, and incidental items necessary to furnish and install a complete shelving system in Inventory Management Stores (Room B112).

Objectives:

• GPO is seeking proposals for the installation of new shelving to replace their current carousels, provided by a

Contractor.

• With modern shelves, Inventory Management can more efficiently keep record of physical stock.

• This request is part of the overall renovation of their space to help improve efficiency and productivity.

Scope:

• GPO Inventory Management plans to have the following done as part of the room’s restoration.

o The existing carousels are to be removed.

o Existing asbestos is to be abated.

o Flooring to be retiled.

o Overhead lights will be installed.

o While Inventory Management aims to refurbish the space, this request solely encompasses the supply of new shelving and the service of its installation.

• The Contractor shall furnish and install an industrial steel shelving system including delivery, assembly, installation, and anchoring as required.

o GPO expects that the shelves be installed with as little interruptions to space renovation and/or operations with Inventory Management as possible.

o The Contractor must comply with Inventory Management and the Contracting Officer’s Representative

(COR) while on site.

• Due to the nature of the work as well as the cruciality of measurements and dimensions in this request, Contractors must visit the site to be considered for bid.

Tasks:

• The Contractor is to provide, assemble, and install eight new steel shelves at Inventory Management Stores at room B112 of GPO’s Washington DC location.

o To account for the variety of inventory being stored, overhead lighting and HVAC, and the overall room layout, the shelves shall adhere to the following specifications:

Each shelf must support a maximum of 1250 lb. with visible labeling on each shelf stating so.

Each shelf must consist of 20 bays with 1 perpendicular bay capped on each end. (see below):

Shelves 1-7

• 20 Bays of 6-beam level shelves o 18” Depth × 48” Width × 10’ Height

• 2 Bays of 6-beam level shelves o 18” Depth × 36” Width × 10’ Height Shelf 8

• 20 Bays of 5-beam level shelves o 18” Depth × 48” Width × 8’ Height

• 2 Bays of 5-beam level shelves o 18” Depth × 36” Width × 8’ Height

Each beam level must include a wire deck o Contractor must provide a proposed layout and drawings adhering to the above specifications for approval before mobilization.

• Contractor must haul any deliveries conducted for this project from the Loading Dock to the site.

• Existing area must be protected at all times.

o The Contractor shall use every available precaution to provide for the safety of property owner, visitors to the site, and all connected with the work under the specifications.

o All existing facilities both above and below ground shall be protected and maintained free of damage.

Existing facilities shall remain operating during the period of construction unless otherwise permitted.

All access roadways must remain open to traffic unless otherwise permitted. Barricades shall be erected to fence off all construction areas from operations personnel.

• GPO will inspect the installed shelving system to verify:

o Compliance with the requirements of this SOW o Proper installation and anchoring o Structural stability o Final acceptance will occur upon satisfactory completion of installation.

• Entire area shall be cleaned after installation to pre-mobilization conditions.

o On completion of work of this section and after removal of all debris, leave site in clean condition satisfactory to COR. Clean-up shall include off the facility disposal of all items and materials not required to remain property of the Government as well as all debris and rubbish resulting from mobilization.

Delivery:

• All palletized products will include packing list listing all contents including part numbers and quantities.

• All material shall be new in unopened factory-sealed cartons or containers.

• Any material that is missing or damaged in shipment shall be replaced at suppliers’ expense.

• Inspection and acceptance of products shall be performed at place of performance or destination, by the COR. The

COR will inspect/accept product to assure the product conform in all respects to the contract specifications. The Contractor will be notified by the Contracting Officer (CO) of equipment that is found not to be in conformance with contractual specifications. Site inspection and acceptance shall be made at destination by cognizant COR.

• Any result of “FAIL” will require the Contractor to:

o Cure the “Reject Reasons”.

o The corrective action is taken to cure the defect.

In the absence of such direction, the contractor shall exercise sound judgment to minimize unnecessary contract costs and performance impacts, for example, performing required work off-site if possible or reassigning personnel to other activities if appropriate.

The contractor shall be responsible for monitoring the Office of Personnel Management at opm.gov, the local radio, television stations, GPO web sites, and other communication channels.

Once the facility is accessible, the contractor shall resume contract performance as required by the contract.

For the period that GPO facilities were not accessible to contractors who required access in order to perform the services, the contracting officer may— Adjust the contract performance or delivery schedule for a period equivalent to the period the GPO facility was not accessible;

Forego the work; or Reschedule the work by mutual agreement of the parties.

Notification procedures of a GPO facility closure, including contractor denial of access, are as follows:

The contractor shall be responsible for notification of its employees of the GPO facility closure to include denial of access to the GPO facility. The dismissal of GPO employees in accordance with statute and regulations providing for such dismissals shall not, in itself, equate to a GPO facility closure in which contractors are denied access. Moreover, the leave status of GPO employees shall not be conveyed or imputed to contractor personnel. Accordingly, unless the GPO facility is closed and the contractor is denied access to the facility, the contractor shall continue performance in accordance with the contract.

(a) Access to Government facilities and resources, including equipment and systems, will be limited and personnel necessary to administer contract performance may not be available. Generally, supply and service contracts that are funded beyond the date of the lapse in appropriation and do not require access to Government facilities, active administration by Government personnel or the use of Government resources in a manner that would cause the Government to incur additional obligations during the lapse in appropriation may continue. If a delivery date for a contract falls during the period of a lapse in appropriations, Government personnel may not be available to receive delivery.

Contractors are directed to consult with a contracting officer before attempting to make a delivery. Contracting officers will be available throughout the lapse in appropriation period to provide guidance.

(b) Once OMB guidance is given, CORs, in consultation with the contracting officer, will notify those contractors that are deemed by the Program Office to be performing excepted work and identify the contractor personnel requiring access to GPO facilities. CORs will also coordinate directly with facility management or physical security personnel at respective locations to ensure that the names of contractor personnel requiring access to Government facilities during the lapse in appropriations are provided to physical security personnel.

(c) Contractors who are not designated as performing excepted work are not allowed access to Government facilities or to utilize Government resources in a manner that would incur any additional obligation of funding on behalf of the Government during the lapse in appropriation.

(d) All contractors working on this contract must undergo fingerprinting and background checks. This includes all subcontractors.

(e) All contractors will be required to pass through metal detectors and all backpacks, toolboxes/bags, lunch boxes etc. will be subject to inspection.

(f) All contractors will be required to exchange their government approved ID badge for a contractor access badge at the beginning of their work shift. Contractors will not be allowed to leave the building with their access badges under any circumstances.

Contractors will exchange their access badges for their personal ID’s at the end of their workday or any time a contractor leaves the building.

(a) This contract is subject to the Contract Disputes Act of 1978, as amended (41 U.S.C. 601-613, and as modified by Section 1501 of Title I of Division H of the Consolidated Appropriations Act, 2008, Public Law No. 110-161).

(b) Except as provided in the Act, all disputes arising under or relating to this contract shall be resolved under this clause.

(c) "Claim," as used in this clause, means a written demand or written assertion by one of the contracting parties seeking, as a matter of right, the payment of money in a sum certain, the adjustment or interpretation of contract terms, or other relief arising under or relating to this contract. However, a written demand or written assertion by the Contractor seeking the payment of money exceeding $50,000 is not a claim under the Act until certified. A voucher, invoice, or other routine request for payment that is not in dispute when submitted is not a claim under the Act. The submission may be converted to a claim under the Act, by complying with the submission and certification requirements of this clause, if it is disputed either as to liability or amount or is not acted upon in a reasonable time.

(d) (1) A claim by the Contractor shall be made in writing and, unless otherwise stated in this contract, submitted within 6 years after accrual of the claim to the Contracting Officer for a written decision. A claim by the Government against the Contractor shall be subject to a written decision by the Contracting Officer.

(2)(i) The Contractor shall provide the certification specified in paragraph (d)(2)(iii) of this clause when submitting any claim exceeding $50,000.

(ii) The certification requirement does not apply to issues in controversy that have not been submitted as all or part of a claim.

(3) The certification may be executed by any person duly authorized to bind the Contractor with respect to the claim.

(e) For Contractor claims of $50,000 or less, the Contracting Officer must, if requested in writing by the Contractor, render a decision within 60 days of the request. For Contractor-certified claims over $50,000, the Contracting Officer must, within 60 days, decide the claim or notify the Contractor of the date by which the decision will be made.

(f) The Contracting Officer's decision shall be final unless the Contractor appeals, within ninety (90) days of receipt of a ContractingOfficer's decision, to the U.S. Government Accountability Office Contract Appeals Board (GAO CAB), 441 G

Street, NW, Room 7182, Washington, DC, 20548; Facsimile: 202-512-9749; E-Mail: CAB@gao.gov.

(g) If the claim by the Contractor is submitted to the Contracting Officer or a claim by the Government is presented to the Contractor, the parties, by mutual consent, may agree to use alternative dispute resolution (ADR). If the Contractor refuses an offer for ADR, the Contractor shall inform the Contracting Officer, in writing, of the Contractor's specific reasons for rejecting the offer.

(h) The Government shall pay interest on the amount found due and unpaid from (1) the date that the Contracting Officer receives the claim (certified, if required); or (2) the date that payment otherwise would be due, if that date is later, until the date of payment. With regard to claims having defective certifications, interest shall be paid from the date that the Contracting Officer initially receives the claim. [A defective certification means a certificate which alters or otherwise deviates from the language in(d)(2)(iii) above, or which is not executed by a person duly authorized to bind the contractor with respect to the claim. Failure to certify shall not be deemed to be a defective certification.] Simple interest on claims shall be paid at the rate, fixed by the Secretary of the Treasury as provided in the Act, which is applicable to the period during which the Contracting Officer receives the claim and then at the rate applicable for each 6- month period as fixed by the Treasury Secretary during the pendency of the claim.
