About this file

This Justification and Approval (J&A) document supports a brand-name sole-source procurement by the 439th Airlift Wing Contracting Flight for HVAC chiller replacement at Westover Air Reserve Base. The contract, valued at less than $750K, requires replacing an existing air-cooled Carrier chiller in Building 1850 with two new Carrier model 30RC_025 or 030 chillers that will provide equivalent cooling capacity. The procurement is a design-build contract with a 349-day performance period (119 days for design, 230 for construction), set aside exclusively for small businesses.

The Air Force has implemented a Department-wide HVAC chiller standardization strategy to reduce total ownership costs, with Carrier Corporation designated as the approved manufacturer for Westover ARB. The solicitation will be competed on SAM.gov, with the goal of reducing training costs, improving mission effectiveness, and supporting small business participation. The contract is expected to be awarded around August 2025, with the procurement justified under FAR 6.302-1 as the chillers are available from a limited number of sources that can meet the agency's specific requirements.

I. Agency and Contracting Activity.

439th Airlift Wing, 439th Airlift Wing Contracting Flight, 250 Airlift Drive, Westover ARB, Chicopee, MA

II. Nature and/or description of the action being approved.

The 439th Airlift Wing Contracting Office intends to award a firm-fixed-price contract around August 2025. Under this contract, the Government requires the replacement of an existing Carrier Model 30RBA07054 air cooled chiller in Building 1850 with two (2) new equal capacity Carrier chillers model 30RC_025 or 030 that combined will provide the required cooling load for the building.

"The Department of the Air Force (DAF) has a requirement to limit the HVAC chiller brand manufacturer on its installations (brand-name) to reduce overall total cost of ownership. Based on existing chiller inventory data and ongoing Air Force Civil Engineer Center (AFCEC) standardization policy compliance, each DAF installation has an approved HVAC chiller manufacturer identified. That selected HVAC chiller brand can be procured competitively among authorized distributors that support the installation. The preponderance of these local distributors are small businesses." (Cat Mgmt 4 - 2024 HVAC Chiller JA - AQ signed 10 Sep 24). Carrier Corp has been named the manufacturer for Westover ARB.

III. Description of supplies/services required to meet agency needs.

The Government will require the awardee to design, procure and install a brand-name requirement for the Carrier model chillers. The objective of this project is to replace existing the air cooled chiller in Building 1850 with two (2) new equal capacity chillers that combined will provide the required cooling load for the building.

This project is a design-build contract with 35%, 95%, and 100% final design submittals. Period of performance is expected to be 349 calendar days (119 for design, 230 for construction) to include delivery of materials with a cost of $ The brand-name component represents approximately of the overall project. Contractor shall verify compatibility to ensure all requirements of the Statement of Work and supporting documentation are met.

The DAF has issued a brand-name Class J&A that covers all DAF HVAC chiller installation-level purchases from 01 Oct 2024 through 30 Sept 2029. (Cat Mgmt 4 - 2024 HVAC Chiller JA - AQ signed 10 Sep 24)

IV. Demonstration that the contractor's unique qualifications or the nature of the acquisition requires use of the authority cited above.

"IAW FAR 6.302-1(a)(2), the HVAC chillers are available from only one or a limited number of responsible sources and no other type of supplies will satisfy agency requirements. Specifically, as described in FAR 6.302-1(b)(4), the DAF has determined in accordance with its HVAC chiller standardization policy that only the makes of the HVAC chiller identified will satisfy the agency's needs for additional units or replacement items for the installations referenced therein." (Cat Mgmt 4 - 2024 HVAC Chiller JA - AQ signed 10 Sep 24)

AFCEC has mandated the standardization to a single manufacturer at the installation levels. Carrier Corp is the approved manufacturer for Westover ARB. Use of Carrier Corp will save the Government duplicative training costs, improve mission effectiveness and reliability, and provide benefits to small business and competition.

V. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under

FAR 5.202 applies.

Solicitation will be posted/competed to the Government Point of Entry, SAM.gov, as a 100% Total Small Business Set-Aside. It is the policy of the Government to provide maximum opportunity for small business to compete for all contracts that can perform the required work.

VI. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

Based upon the estimate and analysis provided by 439th Civil Engineering, the contracting officer expects they will be able to determine that the estimated cost to the Government will be fair and reasonable.

Futhermore, the Government has reasonable expectation of receiving bids from two or more small business firms; therefore, adequate price competition exists and the award can be made at fair market price pursuant to FAR Acquisition Regulations.

If required, price analysis techniques in FAR 15.404-1(b) may be used as guidelines.

VII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.

The DAF conducted comprehensive requirements, market, and gap analyses to develop targeted recommendations for improving DAF HVAC chiller management. Supporting facts in the DAF brand-name Class J&A include the anticipated total cost of ownership reductions associated with HVAC chiller standardization. (Cat Mgmt 4 - 2024 HVAC Chiller JA - AQ signed 10 Sep 24)

Furthermore, market research conducted IAW FAR Part 10 indicated there is an adequate number of small businesses who can perform this acquisition.

VIII. Any other facts supporting the use of Other Than Full and Open Competition.

In order to increase mission performance and cost savings, reduce cyber threats and innovation in business methods, HVAC chiller standardization supports the National Defense Strategy objective to innovate business decisions for saving taxpayer dollars, such as cost avoidance for training. In order to implement this management strategy, the DAF must continue to pre-plan the brand-name HVAC chillers at each location. (Cat Mgmt 4 - 2024 HVAC Chiller JA - AQ signed 10 Sep 24) As previously stated, Carrier Corp is the named manufacturer for Westover ARB.

IX. List of any sources that expressed, in writing, an interest in the acquisition.

N/A

X. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisitions for the supplies or services required.

As previously stated, theDAF has a requirement to limit the HVAC chiller brand manufacturer on its installations (brand-name) to reduce overall total cost of ownership. The only barriers to competition under the brand-name Class J&A have been generated by historical purchases. The DAF will continue to perform data driven analysis over time to validate the HVAC standardization strategy continues to achieve intended mission outcomes and cost improvements. (Cat Mgmt 4 - 2024 HVAC Chiller JA - AQ signed 10 Sep 24)

XI. Certification by the Contracting Officer.

As evidenced by my signature above, I certify that this justification is accurate and complete to the best of my knowledge and belief.
