About this file

This Brand Name Justification document outlines a Department of Navy procurement for Yamaha and Mercury marine engines, lower units, and propellers for the Commander, Navy Region Southwest (CNRSW) Port Operations Regional Small Boat Facility. The procurement seeks specific marine equipment including multiple engine models such as F250NCB, F150 XSA HP, F115XB, and various Mercury engines, totaling 6-8 units per model type. The requirement is a Firm-Fixed Price contract funded by FY25 Operations and Maintenance Navy funds, with equipment delivery expected within 12 months after receipt of order.

The document details extensive market research conducted through SAM.gov sources sought notices and GSA E-buy Request for Information, which yielded limited responses from small businesses. Due to technical constraints and NAVSEA directives, only Yamaha and Mercury components are acceptable, as custodial commands are not authorized to alter existing boat configurations. The procurement will be solicited as Other than Full and Open Competition under 10 U.S.C. 3204(a)(5), with the contracting activity committed to conducting future market research to potentially enable full and open competition. The total contract value is not explicitly stated, but the procurement is for direct replacement of existing marine equipment for harbor security and oil spill abatement boats.

4. STATUTORY AUTHORITY PERMITTING OTHER THAN FULL

AND OPEN COMPETITION:

10 U.S.C. 3204(a)(5): the agency's need is for a brand-name commercial product for authorized resale. In accordance with FAR 13.501(a) Sole source (including brand name) acquisitions.

5. RATIONAL JUSTIFYING USE OF CITED STATUTORY AUTHORITY

CNRSW Port Operations (N31) is responsible for maintaining Naval Sea Systems Command (NAVSEA) assigned Harbor Security and Oil Spill abatement boats, require Original Equipment Manufacturer (OEM) replacement parts. These boats are outfitted with Yamaha and Mercury outboard engines, engine monitoring systems and throttles. All parts listed are direct replacements which include Yamaha and Mercury engines, lower units and propellers. Any other brands are not compatible or interchangeable. These boats operating in excess of 45,000 hours annually are outfitted with Yamaha and Mercury outboard engines, engine monitoring systems and throttles. Custodial commands are not authorized or allowed to alter the model, or make of these components without NAVSEA approval by way of a system wide boat alteration directive Naval Ships Technical Manual 583, Page 17, Par 1.6. 2. Unless otherwise directed by NAVSEA, replacement parts must be OEM as requested per Statement of Work (SOW) for Yamaha and Mercury outboard engines. Other available brands are not interchangeable and therefore repairs, parts, or maintenance services would require a duplication of materials, and maintenance contracts, and training for fire personnel, which would delay readiness given the degraded existing inventory. It would be cost prohibitive to introduce a new brand to our Region.

For the reasons described above, Yamaha and Mercury are essential to the government’s requirements and market research indicates that no other brands’ similar products meet, or can be modified to meet, the agency’s needs.

1. DESCRIPTION OF EFFORTS MADE TO SOLICIT OFFERS FROM AS MANY

OFFERORS AS PRACTICABLE:

Extensive market research was conducted to identify potential sources that could fulfill this requirement. The research involved researching General Services Administration (GSA) catalogs, public searches, SBA database search, and posting a Request for Information (RFI) and sources sought at GSA e-buy and SAM.gov open market.

2. DETEMINATION OF FAIR AND REASONABLE COST:

This requirement will be solicited to the open market. As such, the contracting officer will determine that prices are fair and reasonable using the procedures in FAR 15.404-1 and will document such determination with a level of detail commensurate with the complexity and circumstances of each order.

3. DESCRIPTION OF MARKET RESEARCH CONDUCTED:

The requiring activity and contracting activity have conducted market research. A sources sought (N002425PR00546) on SAM.gov from 03 June 2025 through 13 June 2025 and (2) two responses were received.

Although market research indicates other companies have similar products, CNRSW Port Ops custodial commands are not authorized or allowed to alter the model, or make of these components without NAVSEA approval by way of the system wide boat alteration directive Naval Ships Technical Manual. Purchasing additional equipment from Yamaha and Mercury will ensure that all equipment is compatible with the existing equipment. However, additional market research was conducted this requirement is currently not listed under the Non- Manufacturer Waiver database. Therefore, the Non Manufacturer Rule does apply and this requirement and a small business set-aside will not be possible and this requirement will need to be solicited as Other than Full and Open. The Contracting Officer has elected to not seek a waiver for this requirement.
