About this file

This is a standardized Bid Bond form for the City of Edinburg, Texas, used to secure bids submitted for the Fountain Center Roof Rehabilitation project. The bid bond document establishes the requirements and procedures for bidders to provide financial assurance that they will execute the necessary agreements and performance/payment bonds if their bid is accepted. Bidders must submit either an original bid bond or a copy of a cashier's check as bid security, with the bond penal sum amount to be specified in the bidding documents. The form requires completion of key information including the bidder's name and address, surety company details, owner information, project name and location, bid due date, bond amount, and execution by authorized representatives of both the bidder and surety with corporate seals and Power of Attorney documentation. The bid bond becomes null and void upon acceptance of the bid and timely delivery of the executed agreement and required bonds, rejection of all bids, or failure of the owner to issue a Notice of Award within the specified timeframe (not to exceed 120 days from the bid due date without surety consent).

Default under the bid bond occurs when a bidder fails to deliver the executed agreement and required performance and payment bonds within the time specified in the bidding documents. Payment of the penal sum represents the owner's sole remedy upon default, with payment due within 30 calendar days of written notice of default. Legal action under the bond must commence no earlier than 30 days after notice of default and no later than one year after the bid due date, with jurisdiction limited to courts in the state where the project is located. All notices must be provided in writing via personal delivery, commercial courier, or registered/certified mail to the addresses listed on the bond face. The bond form is designed to comply with all applicable statutory requirements, with any conflicting statutory provisions taking precedence over bond language.
