Summary of Exhibit 3 - Specifications for ESB - US 395 Tree Trimming

This specification document is issued by the Oregon Department of Transportation (ODOT) for a tree trimming and vegetation removal project along US 395 between Mileposts 1.73 (Portal Lane) and 2.47 (Nelson Road). The scope of work requires contractors to furnish and maintain temporary work zone traffic control, fall trees, trim tree canopy, remove brush and vegetation, chip material, and treat hardwood tree trunks with herbicide. Specific clearing requirements include removing all dead or visibly dying trees, trees with diameter at breast height (dbh) equal to or less than six inches, and all limbs and brush within 30 feet horizontal distance from the edge of pavement and 35 feet vertical clearance. Tree stumps must be cut flush or within two inches of the ground surface in the Clear Zone and no higher than four inches above ground surface outside the Clear Zone. All debris, felled trees, foliage, downed trees, brush, and vegetative materials with diameter greater than one inch must be removed from the work area and either chipped on-site or hauled to approved disposal sites. The project is subject to the 2024 Oregon Standard Specifications for Construction, with modifications detailed in the specification document, and ODOT's Temporary Traffic Control Handbook for Operations of Three Days or Less. Migratory bird nesting habitat protection is required, with no vegetation clearing permitted from March 1 through September 1 without written approval, and contractors must provide 10 calendar days' notice before starting activities that could harm nesting birds.

Payment for this project will be made as a lump sum under the item "Tree Removal, Brushing & Cleanup," with the contractor bearing all costs for equipment, labor, materials, supervision, and transportation necessary to complete the work. All cleared material and debris become the contractor's property and may be disposed of through chipping or hauling, with chips spread uniformly in loose layers not exceeding three inches. Herbicide treatment of hardwood tree stumps must use Polaris AC or an approved equivalent, applied as an undiluted concentrate to the outer 1.5 inches of the stump circumference with dye added according to manufacturer specifications, and cannot occur within six hours of rain or near water bodies. The contractor assumes full responsibility and liability for all damages, injuries, and property harm resulting from contract execution and must repair any damage to ODOT or third-party property at its sole expense. The project manager is Teresa Bock, and all work is subject to inspection by the designated ODOT representative, with payment withheld for non-compliant work until deficiencies are corrected at the contractor's expense.
