About this file
This is a Notice of Intent to Award issued by the Oregon Department of Transportation for RFP S-73000-00010942, selecting Timmons Group Inc. as the top-ranked firm for personal services contract negotiations. The solicitation resulted in multiple proposals, with detailed evaluation scores provided in an accompanying matrix. Sarah Chadderdon has been assigned as the ODOT Project Manager and will serve as the primary contact for negotiating the statement of work (SOW), schedule of performance, and costs. The contracting phase follows a structured timeline with specific activities and responsible parties: establishment of work sessions within 5-10 business days, consultant response to SOW comments within 5 days, ODOT PM response within 3 days, submission of Breakdown of Costs (BOC) and billing rates within 5-10 days of final scope, BOC negotiations within 5-10 days of submission, legal sufficiency review within 20 formal days, signature routing within 6-8 days, and Notice to Proceed issuance within 1 day of contract execution. No work is authorized until the contract is fully executed and the written NTP is received. Competing proposers have until 4:00 p.m. on January 14, 2025, to submit written selection protests, with protestors required to demonstrate they were ranked higher than selected proposers and that higher-ranked proposers are ineligible.
Award submittal requirements include submission of a Breakdown of Costs, Certificates of Insurance, Responsibility Inquiry form, Pay Equity Certification if applicable, Business Registry Number, and W-9 Form. The consultant must demonstrate subcontractor utilization to meet the Disadvantaged Business Enterprise (DBE) goal specified in the RFP. ODOT prefers payment via ACH direct deposit for consultants receiving ongoing monthly payments and requests that consultants make reasonable efforts to offer ACH direct deposit to their subcontractors. If negotiations cannot be completed within the prescribed timeline or if good faith agreement cannot be reached on costs, tasks, or other requirements, ODOT reserves the right to terminate negotiations and proceed with the next highest-ranked firm in accordance with applicable Oregon Administrative Rules.

If agreement on costs, tasks, or other requirements cannot be reached within this time frame, ODOT may terminate the negotiations and begin negotiations with the next highest ranked firm as provided in the solicitation and governing Oregon Administrative Rules (OARs).
Note that no work is authorized until the contract is executed and Consultant has received a written NTP from the ODOT PM.
Because this notice is being emailed, the date of this notice will start the protest period for competing proposers to submit a written selection protest (REF Section 5.2). Any proposer who claims to have been adversely affected or aggrieved by the selection of a higher ranked proposer must deliver a written selection protest to my attention and received at the email address below no later than 4:00 p.m. on 1/14/25. ODOT shall not consider a selection protest submitted after the deadline established herein. To be adversely affected or aggrieved, a protestor must demonstrate that the protester was ranked higher than other selected proposers and that higher ranked proposers are ineligible for selection.
ODOT would like to thank each Proposer for your time and efforts in preparing a response to this solicitation.

Direct Deposit via Automated Clearing House (ACH). For Consultants that receive ongoing monthly payments from Agency on one or more contracts or work orders, Agency prefers making Consultant payments via ACH direct deposit. While not required, if Consultant has not previously authorized ACH direct deposit and would prefer ACH to expedite transfer of payments after invoices are approved, Consultant must complete a Vendor ACH Authorization form and submit to Agency per the instructions on the form. To expedite Consultant’s payments to its subcontractors, if applicable, Consultant should make reasonable efforts to offer ACH direct deposit payments.
