(3) Volume 3 – Label “Past Performance.” Include a minimum of 3 but no more than 5 Non-Personal Service Contracts in Acute Care Department of similar or same scope and magnitude within the past five (5) years. Past performance information should include award information including modifications, fully-executed past performance reviews, and other information that demonstrate compliance to price, and technical capability. If available, include past performance evaluations from the Contractor Performance Assessment Reporting System (CPARS).
(4) Volume 4 – Label “Price.” Offerors shall provide detailed pricing aligned with the technical approach. Include a budget narrative explaining cost assumptions and indicate any discount terms.
F. FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2025) (DEVIATION)
(a) Appropriateness of LPTA. The Government will use the Lowest Price Technically Acceptable source selection process only because all conditions at FAR 15.101‑2(c)(1)–(6) are satisfied: (i) the minimum requirements are comprehensively and clearly described using performance objectives, measures, and standards; (ii) the Government would realize no or minimal value from proposals exceeding those minimums; (iii) technical acceptability requires no or minimal subjective judgment; (iv) the Government has high confidence that reviewing higher‑priced technical proposals would not reveal beneficial characteristics; (v) the lowest price reflects total cost of the services being acquired; and (vi) the contracting officer has documented these circumstances in the contract file. Tradeoffs are not permitted; proposals will be rated Acceptable/Unacceptable for non‑price factors and ranked only by price among Acceptable offers.
Basis of Award is Lowest Price Technically Acceptable (LPTA). The award selection will be conducted using LPTA procedures. To be eligible for award, a proposal must meet all technical requirements, conform to all required terms and conditions, and include all information required. All non-price evaluation factors must be rated as "ACCEPTABLE" in order to be eligible for award. An "UNACCEPTABLE" rating in any factor will result in the proposal being rated "UNACCEPTABLE". A proposal rating of "UNACCEPTABLE" makes a proposal ineligible for award. Since the LPTA methodology prohibits trade-offs, all evaluation factors are equally important. Proposals are evaluated for acceptability but are not ranked using the non-price factors.
A price evaluation will be performed for all offerors and proposals will be ranked from lowest to highest price based on the Total Proposed Price (TPP) provided by the offeror on the price schedule sheet. Next, an evaluation of each factor and, subsequently, the overall proposal will be performed beginning with the lowest priced proposal. Award will be made to the lowest evaluated priced proposal meeting the acceptability standards for the non-price factors. The Government intends to award a contract without conducting discussions; therefore, the initial proposal shall conform to the solicitation requirements and should contain the best offer from a technical and price range.
mailto:ashleigh.yazzie@ihs.gov
INTENT TO AWARD WITHOUT DISCUSSIONS: The Government intends to evaluate proposals and award a contract without discussions with Offerors. Therefore, the Offeror's initial proposal should contain the Offeror's best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In the event discussions are held, a competitive range determination will be made. If the Contracting Officer determines the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit efficient competition among the most highly rated proposals. However, The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
In accordance with FAR 15.306, the Government’s decision to award without discussions does not obligate the Government to conduct discussions or clarifications with any Offeror.
The LPTA evaluation process will be accomplished as follows - Technical Acceptability will be comprised of four (4) factors:
1. Administrative Documents: Signed and dated SF-1449 and all associated SF-30 amendments and IEE Form.
2. Technical Capability and approach and all other areas under the PWS which are consistent in the scope Basis of Evaluation: This factor will be evaluated as “ACCEPTABLE” if the explanation meets the requirement for management capabilities and responsibilities. If an explanation of one or more do not comply with the requirements, this factor will receive an “UNACCEPTABLE” rating.
3. Past Performance
a. Solicitation Submittal Requirements: Include a minimum of (3) three but no more than (5) five Non- Personal Service Contracts in Acute Care Department of similar or same scope and magnitude within the past (5) five years. Past Performance information should include award information including modifications, fully executed past performance reviews, and other information that demonstrate compliance to price, and technical capability. If available, include past performance evaluations from the Contractor Performance Assessment Reporting System (CPARS).
b. Basis of Evaluation. Recency: For the purposes of this solicitation, a past performance record is recent if the CPAR final date of assessment listed in the “Period of Performance Being Assessed” block is within the 24-month period preceding a 24-month proposal due date. Relevancy: For the purposes of this solicitation, a past performance record is relevant if the CPAR business sector is listed as “Services”. In order to receive an "acceptable" rating for this factor, an Offer's recent and relevant CPARs must NOT include one or more INTERIM and/or FINAL CPARs with a rating of "UNSATISFACTORY" in one or more categories OR one or more INTERIM and/or FINAL CPARs with a rating of "MARGINAL" in two or more categories. If an Offeror has one or more CPARs with a rating of "UNSATISFACTORY" in one or more categories OR one or more CPARs with a rating of "MARGINAL" in two or more categories, the Offeror's past performance will be evaluated as "UNACCEPTABLE". In the case of an Offeror without a record of recent and relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.” An “UNACCEPTABLE” rating for a single factor will result in the Offeror’s entire proposal being rated “UNACCEPTABLE”.
Note: Past performance will be evaluated for acceptability only using the standards described above.
Comparative assessments among offerors are not permitted under LPTA. If the contracting officer documents under FAR 15.304(c)(3)(iii), past performance need not be an evaluation factor. If it is considered, it will be assessed per FAR 15.305 on an Acceptable/Unacceptable basis only.
4. Price – Refer to 52.212-1 #4 Volume 4 – Label “Price”
a. Basis of Evaluation: The Government will evaluate price based on the total proposed price calculated as the sum of contract line items that includes Contract cost, Subcontractor cost (if applicable), Overhead and Profit. Analysis will be conducted by one or more of the following to ensure a fair and reasonable price: (i) Comparison of proposed prices received in response to the RFP. (ii) Comparison of proposed prices with the IGE. (iii) Comparison of proposed prices with available historical information.
Note: A price that is found to be either unreasonably high or unrealistically low in relation to the proposed work may be indicative of an inherent lack of understanding of the solicitation requirements and may result in the overall proposal being considered unacceptable.
Labor‑Hour Rate Realism:
Because this acquisition will result in a Labor‑Hour contract, the Government may consider unrealistically low labor‑hour rates as evidence of a failure to understand the requirements. Quotes with materially unbalanced or unrealistic rates may be rated Unacceptable.
(a) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the government to exercise the option(s).
(b) Notice of award. Responsibility Determination: Prior to award, the Government will determine that the prospective awardee is responsible in accordance with FAR 9.104‑1, is ISBEE‑eligible, actively registered in SAM, and not listed on the HHS OIG Exclusion List. Failure to meet responsibility requirements may result in the Offeror being bypassed for award even if its quotation is otherwise Lowest Price Technically Acceptable.
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
G. The Government will award a contract resulting from this solicitation to the responsible offeror whose conforming to the solicitation will be most advantageous to the government, evaluation factors and price will be considered.
H. For evaluation purposes only, the Government will evaluate the total price of the base period and all option periods. Evaluation does not obligate the Government to exercise any option.
I. FAR 52.212-4 Contract Terms and Conditions-Commercial Products and Commercial Services – Alternate I (NOV 2025). Applied to this acquisition and it’s by reference.

(DEVIATION)
A. FAR 52.212-2 Evaluation – Commercial Products and Commercial Services (NOV 2025) (DEVIATION)
Appropriateness of LPTA. The Government will use the Lowest Price Technically Acceptable source selection process only because all conditions at
FAR 15.101-2(c)(1)–(6) are satisfied: (i) the minimum requirements are comprehensively and clearly described using performance objectives, measures, and standards; (ii) the Government would realize no or minimal value from proposals exceeding those minimums; (iii) technical acceptability requires no or minimal subjective judgment; (iv) the Government has high confidence that reviewing higher-priced technical proposals would not reveal beneficial characteristics; (v) the lowest price reflects total cost of the services being acquired; and (vi) the contracting officer has documented these circumstances in the contract file. Tradeoffs are not permitted;
proposals will be rated Acceptable/Unacceptable for non-price factors and ranked only by price

Basis of Award is Lowest Price Technically
Acceptable (LPTA). The award selection will be conducted using LPTA procedures. To be eligible for award, a proposal must meet all technical requirements, conform to all required terms and conditions, and include all information required.
All non-price evaluation factors must be rated as
"ACCEPTABLE" in order to be eligible for award.
An "UNACCEPTABLE" rating in any factor will result in the proposal being rated
"UNACCEPTABLE". A proposal rating of
"UNACCEPTABLE" makes a proposal ineligible for award. Since the LPTA methodology prohibits trade-offs, all evaluation factors are equally important. Proposals are evaluated for acceptability but are not ranked using the non-price factors.
A price evaluation will be performed for all offerors and proposals will be ranked from lowest to highest price based on the Total Proposed
Price (TPP) provided by the offeror on the price schedule sheet. Next, an evaluation of each factor and, subsequently, the overall proposal will be performed beginning with the lowest priced proposal. Award will be made to the lowest evaluated priced proposal meeting the acceptability standards for the non-price factors. The Government intends to award a contract without conducting discussions;
therefore, the initial proposal shall conform to the solicitation requirements and should contain the best offer from a technical and price range.
INTENT TO AWARD WITHOUT DISCUSSIONS: The
Government intends to evaluate proposals and award a contract without discussions with
Offerors. Therefore, the Offeror's initial proposal should contain the Offeror's best terms from a price and technical standpoint. The
Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In the event discussions are held, a competitive range determination will be made. If the Contracting
Officer determines the number of proposals that would otherwise be in the competitive range

Officer may limit the number of proposals in the competitive range to the greatest number that will permit efficient competition among the most highly rated proposals. However, The Government reserves the right to conduct discussions if the
Contracting Officer later determines them to be necessary.
In accordance with FAR 15.306, the Government’s decision to award without discussions does not obligate the Government to conduct discussions or clarifications with any Offeror.
The LPTA evaluation process will be accomplished as follows - Technical Acceptability will be comprised of four (4) factors:
1. Administrative Documents: Signed and dated
SF-1449 and all associated SF-30 amendments and
IEE Form.
3. Past Performance
a. Solicitation Submittal Requirements: Include a minimum of (3) three but no more than (5) five
Non-Personal Service Contracts in Acute Care

Past Performance information should include award information including modifications, fully executed past performance reviews, and other information that demonstrate compliance to price, and technical capability. If available, include past performance evaluations from the Contractor
Performance Assessment Reporting System (CPARS).
b. Basis of Evaluation. Recency: For the purposes of this solicitation, a past performance record is recent if the CPAR final date of assessment listed in the “Period of Performance Being

75H70626Q00076 a past performance record is relevant if the CPAR business sector is listed as “Services”. In order to receive an "acceptable" rating for this factor, an Offer's recent and relevant CPARs must
NOT include one or more INTERIM and/or FINAL
CPARs with a rating of "UNSATISFACTORY" in one or more categories OR one or more INTERIM and/or
FINAL CPARs with a rating of "MARGINAL" in two or more categories. If an Offeror has one or more
CPARs with a rating of "UNSATISFACTORY" in one or more categories OR one or more CPARs with a rating of "MARGINAL" in two or more categories, the Offeror's past performance will be evaluated as "UNACCEPTABLE". In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.” An
“UNACCEPTABLE” rating for a single factor will result in the Offeror’s entire proposal being rated “UNACCEPTABLE”.

Pine Ridge Indian Health Service Acute Care Nursing Services Performance Work Statement
Performance Work Statement (PWS) Acute Care Nursing Services for the Pine Ridge Hospital
Great Plains Area Indian Health Service
This is a Labor-Hour, Non-Personal Services Requirement. While limited performance – based elements are included, the Government prescribes minimum staffing levels, work schedules, and coverage requirements due to the mission-critical nature of outpatient healthcare services.
1) Background
The mission of the Pine Ridge Service Unit (PRSU) Indian Health Service is to raise the physical, mental, social and spiritual health of American Indians and Alaska Natives to the highest level. To meet this mission, The Pine Ridge Service Unit requires contractor support to assist the nursing department during times of acute nursing staff shortages. The Pine Ridge Reservation is located in the southwestern corner of South Dakota, approximately 100 miles from Rapid City. Surrounded by rolling prairie, Badlands and Black Hills, the Pine Ridge Reservation is home to the Oglala Lakota Nation.
C.2) General Requirements
C.2.1 Purpose of Contract The Contractor shall provide qualified Registered and Licensed Practical Nurses to work at the PRSU for acceptance by the Chief Nurse Executive, Deputy Chief Nurse Executive or CEO Designee at PRSU. The purpose of this non-personal service contract is to provide direct patient care, supporting the current Acute Care Nursing staff which includes all specialty clinics and PRSU outlaying locations i.e. community outreach, especially in times of staffing shortages.
1. Require the contractor to be a temporary nursing agency; No more than 50% of the contractor workforce will be accepted with Licensed Practical Nurse qualifications. Contractor personnel shall work in an Out-Patient Clinic Nursing Department, but may be floated to the Emergency Room or Acute Care In-Patient units to act as a patient observer or pass medications or other intermittent care needs as staffing needs arise. Contractor personnel will be assigned to a shift after orientation that supports the mission of the facility, but may be either a day or evening shift. The shifts are either 8 or 10 hours.
2. Require Contractor to assume sole and exclusive responsibility for withholding federal and State taxes, paying federal and social security taxes.
The minimum staffing requirement for this contract is the equivalent for 0-10 full time Registered Nurses and Licensed Practical Nurse nursing services to the Pine Ridge Service Unit over the course of the contract. Since the PRSU operates 365 days a year, this contract may require multiple individual Contractor Personnel to meet this requirement. The Government may significantly increase or decrease the level of effort of this task order at any time by contract modification in response to staffing requirements. It is of utmost importance the contractor renders seamless coverage and provides continuity care. The contractor shall furnish licensed, experienced personnel, with the relevant background in accordance with the terms and conditions specified in the resulting contract.
The Number of RNs/LPNs are not to exceed 10 providers throughout the duration of this contract. The RNs/LPNs will be assisting in all areas of the Acute Care Nursing department.
C.2.2 Contract Type This is a labor hour type service contract for Acute Care Nursing Department Nursing Services for the Pine Ridge Service Unit which consist of Pine Ridge IHS Hospital. However, there are significant constraints on the contractor's solution to achieving the purpose of this contract.
The PRSU staffing levels are determined by acuity and standards of care. Therefore, this contract establishes a minimum level of support coverage that must be maintained during each shift. While there are no restrictions on the maximum number of Contractor Personnel hired for this contract, the nursing service physical presence cannot fall below contractually established minimums regardless of patient workload. The practical consequence of this for the Contractor is that although it is a performance-based contract, the staffing requirement takes on the characteristics of a labor hour contract in that the contract identifies specified skill types/levels for a stipulated number of hours.
Throughout this contract, all references to "Contractor" refers to the awardee. All references to "Contractor Personnel” refer to Contractor staffing provided in support of the contract.
C.2.3 Contract Performance Period The contract performance period will be for 90 days from award date.
In addition, this contract can be terminated for the convenience of PRSU if, a sufficient number of permanent government providers are hired to serve in this work capacity. In this event, an authorized government CO shall provide a preliminary written notice to contractor, 60 days in advance.
***The Government may require the removal and replacement of Personnel as a result of security actions or other reasons, e.g., removal of unqualified or habitually careless Personnel or the removal of Personnel that cannot perform the assigned tasks or display unacceptable conduct and behavior.
C.2.4 Contract Place of Performance Pine Ridge Service Unit 607 Indian Health Road, Pine Ridge, SD 57770.
C.3) Labor Hour Type Requirements
C.3.1 Scope The contractor shall furnish Acute Care Nursing services.
