This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Subpart 12.6, using Simplified Acquisition Procedures under FAR part 13 as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation SHALL be posted on SAM at sam.gov.
The solicitation number for this is N0018921Q0423 and will be issued as an RFQ. This solicitation documents and incorporates provisions and clauses in effect through FAC 2021-06 (effective 07-12-2021) and DFARS Publication Notice (Effective 07-09-2021).

The NAICS code is 512230 and the Small Business Standard is 750 (# of employees). The proposed contract action is for supplies or services for which the Government intends to solicit and negotiate a Firm Fixed Price contract with only one source, Ellen Zwilich as represented by Theodore Presser Company, under the authority of FAR 13.106-1(b). Interested persons may identify their interest and capability to respond to the requirement or submit quotes.
This notice of intent is not a request for competitive quotes. However, all quotations received by the closing response date will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. The Small Business Office concurs with this determination - please see attachments for a redacted Sole Source Justification.
Responsibility and inspection: unless otherwise specified in the order, the supplier is responsible for the performance of all inspection requirements and quality control.

SOURCES SOUGHT SYNOPSIS
This is a Sources Sought Notice ONLY. The U.S. Government desires to procure a Popular Musical Production for The United States Military Academy’s West Point Band, at West Point, NY on a small business set-aside basis, provided 2 or more qualified small businesses respond to this sources sought synopsis with information sufficient to support a set-aside. Be advised that the U.S. Government will not be able to set aside this requirement if 2 or more small businesses do not respond with information to support the set-aside. We encourage all small businesses, in all socioeconomic categories (including, 8(a) Business Development Program, Small Disadvantage Business, Historically Underutilized Business Zone, Service-Disabled Veteran-Owned, Women-Owned Small Business concerns), to identify their capabilities in meeting the requirement at a fair market price.
This notice is issued solely for information and planning purposes – it does not constitute a Request for Quote (RFQ)/Invitation for Bid (IFB)/Request for Proposal (RFP) or a promise to issue an RFQ, IFB or RFP in the future. This notice does not commit the U.S. Government to contract for any supply or service. Further, the U.S. Government is not seeking quotes, bids or proposals at this time and will not accept unsolicited proposals in response to this sources sought notice. The U.S. Government will not pay for any information or administrative costs incurred in response to this notice. Submittals will not be returned to the responder. The anticipated NAICS code(s) is 711510 – Independent Artists, Writers and Performers with a size standard of $8 million.
A need is anticipated for a Popular Musical Production for the West Point Band, at the United States Military Academy, West Point, NY 10996.
In response to this sources sought, please provide:
1. Name of the firm, point of contact, phone number, email address, DUNS number, CAGE code, a statement regarding small business status (including small business type(s)/certifications(s) such as SDB, 8(a), HUBZone, SDVOSB, WOSB, etc.) and the corresponding NAICS code.
2. Identify whether your firm is interested in competing for this requirement as a prime contractor or not. Identify subcontracting, joint ventures or teaming arrangement that will be pursued, if any.
3. Information in sufficient detail regarding previous experience (indicate whether as a prime contractor or subcontractor) on similar requirements (include size, scope, complexity, timeframe, government or commercial), pertinent certifications, etc., that will facilitate making a capability determination.
4. Information to help determine if the requirement for a Musical Symphony is commercially available, including pricing information, basis for the pricing information (e.g., market pricing, catalog pricing), delivery schedules, customary terms and conditions, warranties, etc.
5. Identify how the Army can best structure these contract requirements to facilitate competition by and among small business concerns.
6. Identify any condition or action that may be having the effect of unnecessarily restricting competition with respect to this acquisition. The U.S. Army, West Point Mission Installation Contracting Command Office, (MICC) is issuing this solicitation for a Popular Musical Production for the West Point Band, at West Point, NY.
This requirement will be 100% set aside for Small Business concern under NAICS code 711510 Independent Artists, Writers and Performers, size standard is $8.0 Million per year and FSC/PSC of 7660.
In order to be eligible for award, an offeror must be registered as a Small Business concern under the appropriate NAICS code in the System for Award Management (SAM) at www.sam.gov.
Please verify that both your DUNS #, Cage Code are current and valid in the SAM system.
