JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY
Contracting Activity: Naval Facilities Engineering Command Southeast (NAVFAC SE), Integrated Product Team South Atlantic (IPT SA), with offices at Naval Air Station (NAS) Jacksonville, Florida. Requiring Activity: Navy Undersea Warfare Center Detachment, Atlantic Undersea Test and Evaluation Center (NUWC DET AUTEC), at Andros Island, Bahamas. Description of the Action Being Approved: Modification to increase the capacity of the Global Contingency Construction Multiple Award Contract (GCCMAC) Task Order (TO) N62470-13-D-6022-JM01 by $2,950,000.00, from $650,000.00 to $3,600,000.00. TO, awarded on 19 October 2016 to URS Group, Inc, 1600 Perimeter Park Dr.
Ste. 400, Morrisville, NC 27560-8421, for Hurricane Matthew Recovery at NUWC DET AUTEC, Andros Island, The Bahamas. Description of Supplies/Services. The proposed modification includes providing all labor, material, equipment, supervision and insurance required to repair buildings 1206, 1602, 1684, 1604, and 1701 at AUTEC for stabilization and continuity of base operations. The work to be provided under this modification includes: Repair of building structure and roof framing system, Repair of the roof and moisture proofing system of the affected buildings, Repair of all damaged windows and doors, Dry and dehumidify building interior finishes (interior partitions, carpet, floor, etc.), Replace all irreparable interior finishes, Interior mold remediation, and Selective demolition and disposal of all irreparable material.
Requirements will be further defined by the Contracting Officer during the execution of the Work. Contractor may be directed to provide temporary repairs in order to avoid further damage to building interiors, like covering roofs with tarp and boarding up doors and windows, until permanent repairs are in effect. Work in some of the facilities affected requires special security procedures that affect work productivity. Below is an initial assessment of damages identified by the NAVFAC SE team and provides the order of precedence of work to be performed: Priority 1 – Dental Clinic (BLDG 1206) - Major Roof Repairs, Priority 2 – Network Operations Center (BLDG 1701) - Major Roof repairs, Asbestos abatement, Major Structural repairs, Priority 3 - Range Support Shop with Cranes (BLDG 1602) - Major Roof repairs (fiberglass panel roofing and horizontal roll roofing), Asbestos abatement, Lightning protection system needs to be replaced 100%, Partial interior ceiling replacement, Priority 5 – Torpedo Post-Run Testing Facility with Cranes (BLDG 1684) - Roof repairs, HVAC repairs, Interior repairs, Exterior repairs, Priority 6 – Command Control Admin (BLDG 1604) -Roof repairs, Siding and flashing repairs, Door repairs.
Statutory Authority Permitting Other Than Full and Open Competition: FAR 16.505(b)(2)(i)(A) The agency need for the supplies or services is so urgent that providing fair opportunity would result in delays. FAR 16.505(B)(2)(i)(A) indicates that when the agency’s need for the supplies or services is of such urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals when using a multiple award indefinite-quantity contract and full and open competition need not be provided for. The approval requested herein is for actions required to preserve the structure and contents of the buildings referenced above from further damage after they were severely affected by the passing of hurricane Matthew.
The current GCCMAC contingency construction contractor has already contributed to the damage assessment performed after the hurricane, is familiar with the work to be performed, has been vetted through the base security process and has the required clearances needed to perform work throughout the entire base.

12/7/16, 9:57 AM J and A for Increase in Capacity of Current NAVFAC Atlantic Global Contingency Construction (GCC) Indefinite Delivery / Indefinite Quantity (IDIQ) Multiple Award Contract (MAC)
On or about 02 July 2012, Naval Facilities Engineering Command, Norfolk, VA intends to issue a Request for Proposal (RFP) for a Global Contingency Construction Contract. The closing date for receipt of proposals will be indicated on the solicitation. The solicitation will be unrestricted. The North American Industry Classification System (NAICS) is 236220, Commercial and Institutional Building Construction with a Size Standard of $33,500,000 as work for task orders issued under resultant contracts will primarily lie within this NAICS Code. Task orders may also include work under other Construction Sector NAICS Codes (e.g. 237310 Highway, Street, and Bridge Construction and 237990 Other Heavy and Civil Engineering Construction). The Government intends to award an Indefinite Delivery Indefinite Quantity - Multiple Award Contract (GCC-MAC) with provisions to issue Cost Plus Award Fee and Firm-Fixed Price task orders. The Government may award the contract to more than one contractor. The Government may award up to four (4) contracts as a result of the solicitation. Each contract will be for a base year and four (4) one-year option periods. The total maximum value for the GCC-MAC is Not to Exceed $800 million (base year and four option years), including all contracts awarded under the RFP. The minimum guarantee for each contract is $25,000. Future Task Orders will be competed among the awardees. The Government will give fair consideration to all awardees in placing orders based on criteria stated in the solicitation. If the Government does not award a follow-on contract in time, the Government may require Contractor’s to continue performance for an additional period up to six months under the Option to Extend services. This contract will replace the current contract for similar services awarded in August 2006. The total maximum value of the current contract is $1 Billion over the 5 year life of the contract. Information about the current contract and incumbent contractors (e.g. value of contracts, firm’s names, addresses, etc) will be included in the solicitation package. Requests under the Freedom of Information Act are not required for this information. The solicitation will utilize source selection procedures in accordance with FAR part 15, (Best Value/Tradeoff process), which require offerors to submit a technical proposal, past performance, safety and small business utilization information; and a cost proposal for evaluation by the Government. The work includes but is not limited to providing supervision, equipment, materials, labor, travel and all means necessary to provide the Navy, the Navy on behalf of DOD, and the Navy on behalf of other Federal agencies when authorized, an immediate response for civilian construction contract capability. Construction and related engineering and services would be in response to natural disasters, humanitarian assistance, conflict, or projects with similar characteristics. This includes occasional projects to ensure readiness to perform under emergency situations. The scope includes the capability to provide general mobilization services (embarkation) for personnel, equipment and material in support of Naval Construction Forces (NCF) mobilization and similar mobilization efforts. The work also includes the capability to set up and operate a Material Liaison Office (MLO) at a deployed site in support of NCF operations. The Contractor may be tasked to participate in military exercises. Work will be predominately construction. The Contractor, on a limited basis and incidental to construction services, may be required to provide Base Operating Support (BOS) Services such as: Air Operations; Port Operations; Morale, Welfare and Recreation Support; Galley; Billeting; Facilities Support; Utilities; Base Support Vehicles and Equipment; and Environmental services. These services are primarily anticipated in support of facilities overseas, but may also be ordered for work in the United States in support of disaster recovery efforts and other contingency operations. Applicable labor requirements and clauses will be incorporated by individual task order, as necessary, for work performed in the United States. The Government reserves the right to reject any or all proposals prior to award; to negotiate with any or all proposers; to award the contract to other than the lowest total price; and to award to the proposer submitting the proposal determined by the Government to be the most advantageous to the Government. Proposers are advised an award may be made without discussion or any contact concerning the proposals received. Proposers should not assume they will be contacted or afforded the opportunity to qualify, discuss, or revise their proposals. However, the Government may contact proposers to clarify aspects of their proposal. The Government also reserves the right to enter into discussions if deemed necessary. If discussions are conducted proposers in the competitive range may be afforded the opportunity to revise their proposals. The Government may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. When issued, the solicitation will be available in electronic media only and can be downloaded free of charge via the Internet World Wide Web at https://www.neco.navy.mil or http://www.fbo.gov under pre-solicitation notice N62470-12-R-5010. There will be no paper copies of the solicitation issued. Amendments will be posted on NECO website for downloading.
