About this program

The Department of Justice Office of Justice Programs Bureau of Justice Assistance funds reimbursement payments to states and local government units for correctional officer salary costs and other specified incarceration expenses related to undocumented criminal aliens meeting statutory criteria, Assistance Listing 16.606, with an open fiscal year 2025 opportunity due July 14, 2026.

The program operates on a statutory formula rather than competitive merit review. Eligible applicants—states, counties, cities, and townships—submit data on undocumented criminal aliens they incarcerated for at least four consecutive days during a 12-month reporting period, provided those individuals had been convicted of at least one felony or two misdemeanors under state or local law. OJP transmits submitted inmate data to the Department of Homeland Security for verification. Payments are calculated pro-rata based on applicant-reported incarceration costs, DHS validation results, and available annual appropriations. Awards are typically obligated and announced by late September and released for drawdown by mid-October. SCAAP funds are no-year monies with no time restriction on expenditure and must be deposited to recipients' general funds; recipients have 45 calendar days to accept awards via JustGrants after notification.

Award activity remains active but has contracted sharply. The program has disbursed 2,633 grants totaling $2.09 billion since 1995. Recent award volume has declined dramatically—547 awards annually in 2018–2019 versus only two in 2023. The portfolio comprises predominantly Project Grants (61 percent) and Formula Grants (39 percent), with two Cooperative Agreements. Both funding agencies are within DOJ: the Office of Justice Programs proper accounted for 1,572 awards ($1.66 billion), while the Bureau of Justice Assistance separately recorded 1,061 awards ($433.4 million).

Recent award magnitudes vary widely. The most recent reimbursement awards from July 2019 ranged from $34 to $62.9 million; illustrative examples include New York's Suffolk County Sheriff ($2.18 million), Florida's Broward County ($2.14 million), and a large single award for incarcerating undocumented criminal aliens ($62.9 million). Two October 2023 Cooperative Agreements funded technical assistance: the Vera Institute of Justice received $1.5 million to support eight corrections agencies in transforming prison cultures under the "Designed for Dignity" framework, and the Institute for Intergovernmental Research received $500,000 to develop a resource hub for corrections best practices.

The fiscal year 2025 SCAAP opportunity (O-BJA-2025-172612) is open and recently reopened, seeking applications for reimbursement of costs incurred during the July 1, 2023–June 30, 2024 reporting period. Eligible applicants are states, counties, cities, and townships with legal authority to incarcerate qualifying individuals. Prior-year opportunities opened annually in spring and early summer with deadlines in June or July. Applications undergo eligibility, responsiveness, merit, programmatic, budget, and risk review as specified in each NOFO; final award decisions are made by the Assistant Attorney General.

Length and time phasing of assistance

SCAAP awards are usually obligated and announced by the end of September and released for drawdown by mid-October. There are no restrictions placed on the time permitted to spend the money awarded because SCAAP funds are considered no year funds. SCAAP funds must be used for correctional purposes only. Jurisdictions receiving SCAAP awards will be asked to report the projected use of these funds at the time the award is accepted. Method of awarding/releasing assistance: SCAAP payments are calculated simultaneously, with applicants receiving a prorated payment based on the appropriation; costs submitted, and inmates as determined by DHS. All SCAAP payments are made electronically to the applicant's bank account of record identified during the application process. Please use the jurisdiction's Unique Entity Identifier when applying for SCAAP funds. Once SCAAP data has been validated and analyzed, applicants will receive e-mail notification that awards are ready for online acceptance and drawdown. Formal acceptance of an award via the Department of Justice, Office of Justice Programs Justice Grants (JustGrants) system is necessary for the electronic transfer of funds into the applicant's bank account of record. Applicants have 45 calendar days to accept awards through JustGrants once notice is provided. SCAAP payments must go to the jurisdictions' general fund.

How to apply
