About this opportunity
The Commonwealth of Kentucky's Transportation Cabinet, Division of Purchases, issued Request for Bid (RFB) 2100000555 on March 30, 2021, on behalf of the Department of Highways, District 9, seeking to procure 150 pieces of used railroad rails measuring 40 feet in length for a total of 6,000 linear feet. The rails must meet specifications of 136 pounds or greater per linear yard, be constructed entirely of steel, and be straight and structurally sound, with legible manufacturer classification stamps on the web and a hole cut near the end for picking and lifting purposes. The material will be delivered in three equal installments of 50 pieces (2,000 linear feet each) to three separate KYTC maintenance facilities located in Boyd County (Ashland), Carter County (Grayson), and Fleming County (Flemingsburg), with all deliveries requiring F.O.B. Destination Freight Prepaid and Allowed terms. The bid closing date is April 6, 2021, at 1:30 p.m. Eastern Time, with a tentative award date of April 7, 2021, and a one-time contract structure with no renewal options. All responses must be submitted exclusively through the Kentucky Vendor Self Service e-Procurement system, with actual bid prices entered on the provided bid sheet as an attachment; hard copy and emailed submissions will not be accepted. The award will be determined using a "best value" evaluation method based on price (95 points) and vendor response time guarantee in calendar days (5 points), with the lowest-priced bidder receiving the maximum score, and all material must conform to the Kentucky Transportation Cabinet's 2019 Standard Specifications for Road and Bridge Construction with acceptance based on visible inspection by the engineer.
Kentucky resident bidders meeting specified residency requirements are eligible for reciprocal preference against nonresident bidders from states that provide similar preferences, and qualified organizations including Kentucky Correctional Industries, Kentucky Industries for the Blind, and certain nonprofit organizations serving individuals with severe disabilities may receive preference equal to 20 or 15 percent of maximum points. All bidders must complete vendor registration with the Kentucky Vendor Self Service System prior to submission, a process requiring 24 to 48 hours, and must submit an executed Annual Affidavit confirming compliance with Kentucky campaign finance laws (KRS 45A.110 and 45A.115), current registration with the Kentucky Department of Revenue for sales and use tax collection, non-delinquency on state taxes and fees, and non-participation in jurisdictional boycotts as defined in KRS 45A.607. Vendors bear full responsibility for freight charges and filing any freight claims, with a penalty of one percent per day deducted from invoices for late deliveries beyond the contracted date, though vendors are not liable for delays caused by circumstances beyond their control. Payment will be made within 30 working days of receipt of goods and proper invoicing in accordance with Kentucky statutes, with an additional penalty of one percent per month if payment exceeds 30 working days. Bids remain valid for a minimum of 90 calendar days after the closing date, and vendors must notify the engineer a minimum of 24 hours prior to scheduled delivery and allow six hours for unloading by district personnel.
