About this opportunity

The Commonwealth of Kentucky, through the Kentucky Transportation Cabinet (KYTC) Division of Purchases on behalf of the Division of Maintenance, is soliciting bids for a Master Agreement for scrap metal and aluminum recycling services via Request for Bid (RFB) 605_2300000336_1_SO. The procurement seeks vendors to provide receiving locations where KYTC personnel will deliver scrap materials; vendors are not required to provide pickup services at KYTC facilities. The goods being procured include three categories of scrap materials: No. 1 Heavy Melt scrap metal, Secondary Smelter's Aluminum Scrap, and Mixed Scrap Aluminum and Metal, with aluminum required to be segregated and priced separately from other metals. Vendors must submit percentage-based pricing representing the percentage of the American Metal Markets (AMM) Chicago Market Price they are willing to pay for each scrap material category, with all pricing firm for the contract period. Vendors are required to provide state-certified scales at their locations, furnish weight tickets and current AMM Chicago Market Price documentation to KYTC drivers upon each delivery, and make payment by check payable to the Kentucky State Treasurer at the time of delivery. The RFB was issued on December 8, 2022, with a bid closing date of December 22, 2022, at 1:30 p.m. Eastern Time, and a tentative award date of December 28, 2022. All bids must be submitted electronically through the Kentucky eProcurement system; no paper or emailed bids will be accepted. The initial contract period begins upon award and expires on September 30, 2023, with the Master Agreement eligible for extension for four additional one-year periods with written approval from both the vendor and KYTC Division of Purchases.

Resident bidders must submit a Required Annual Affidavit for Bidders, Offerors and Contractors attesting to compliance with Kentucky campaign finance laws, executive agency lobbyist restrictions, sales and tax registration requirements, and state tax payment obligations, while nonresident bidders must provide a Certificate of Authority from the Kentucky Secretary of State. All bidders must execute mandatory compliance certifications confirming they have not violated Kentucky campaign finance laws, are registered with the Kentucky Department of Revenue for sales and use tax collection, are not delinquent on state taxes or fees, and are not engaged in prohibited boycotts of jurisdictions with which Kentucky maintains open trade. The Commonwealth reserves the right to reject bids deemed too low and will award Master Agreements to all responsive bidders who submit reasonable percentages; multiple contracts may be awarded to serve different counties or locations. Sales tax must be included in payments unless an applicable exemption applies. The solicitation documents do not identify incumbent vendors, current contractors, or specific budget ranges, though the contract will serve the KYTC Division of Maintenance and all Highway Districts statewide. No set-aside designations or restrictions targeting disadvantaged enterprises are specified in the solicitation materials.
