About this opportunity
The Commonwealth of Kentucky, Division of Oil and Gas, in partnership with the Finance and Administration Cabinet's Division of Engineering and Contract Administration, is procuring construction services for the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW) Lee County #004 project. This Request for Proposal (RFP-193-26) seeks competitive proposals for orphan well plugging and remediation services at ten identified sites within Lee County, Kentucky (permit numbers: N1586, N1461, N25145, 27936, N2090, 198-E0, 199-E0, 28077, N22959, and N25144). The scope of work includes comprehensive well abandonment services encompassing obstruction removal, wellbore verification, cement plugging from total depth to surface, and complete wellsite and access road reclamation, with all work to comply with state and federal regulations, including Davis-Bacon Act prevailing wage requirements. The contract is awarded on a firm fixed-price basis with the right to adjust pricing if individual sites are deleted. Proposals are due February 27, 2026, at 3:00 p.m. Eastern Time, with written vendor questions due by February 9, 2026, and anticipated contract award on March 16, 2026. Substantial completion is required within 365 calendar days of award with final completion within one additional year, subject to liquidated damages of $200 per calendar day for delays. Technical evaluation will be scored on a 25-point scale assessing prime and subcontractor experience, project history, equipment adequacy, work plan completeness, and past performance with the Division of Oil and Gas, with an additional 45 points allocated proportionally based on cost, with the lowest bid receiving maximum cost points. Proposals must be submitted as a single PDF document following precise organizational requirements including cover page, transmittal letter, bidder qualifications, prior projects summary, equipment lists, work plan, Davis-Bacon documentation, subcontractor identification, cost proposal with bidder response forms, annual affidavit, and a 5% bid bond.
The procurement is subject to reciprocal preference for Kentucky resident bidders and preferences for qualified bidders as outlined in Kentucky Administrative Regulations 200 5:410. Bidders must certify that they have no affiliation with parties that owned, operated, or abandoned the wells and must comply with Kentucky nondiscrimination and affirmative action requirements. Successful bidders will be required to furnish 100% Performance and Payment Bonds within five calendar days of award and maintain commercial general liability insurance of $1,000,000 combined single limit per occurrence. The contract includes comprehensive insurance and bonding requirements, with the Commonwealth reserving all standard federal and state compliance obligations including Equal Employment Opportunity and accessibility standards. If technologically enhanced naturally occurring radioactive material (TENORM) impacted metals are discovered exceeding twice background levels during remediation, contractors will be reimbursed documented disposal costs plus 10% administrative fees upon submission of satisfactory documentation and shipping manifests. The contract is federally funded through Department of the Interior grant sources subject to 2 CFR Part 200 (Uniform Guidance) requirements, and the Commonwealth of Kentucky is not tax-exempt, making winning bidders liable for Kentucky sales and use tax. No specific contract value or budget range is provided in the solicitation documents, though pricing will be established through the competitive bidding process with award to the lowest responsive bidder.
