About this opportunity

The Commonwealth of Kentucky, Department of Energy and Environment Cabinet (Division of Oil and Gas), in partnership with the Finance and Administration Cabinet (Division of Engineering and Contract Administration), is issuing RFP-182-25 for the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW) Package N. This firm-fixed-price procurement seeks competitive proposals for the remediation and reclamation of abandoned tank facilities located across four counties: Ohio, McLean, Daviess, and Hancock. The scope of work includes the removal and proper disposal of surface storage tanks (ranging from 100-barrel steel tanks to 2,500-gallon units, fiberglass, and plastic tanks), abandonment of associated flow lines, removal of contaminated soil to a maximum depth of three feet (with estimated tonnage ranging from 7 to 25 tons per location), elimination of berms and dikes, site reclamation using best management practices, and proper disposal of oil or brine-contaminated materials and TENORM (naturally occurring radioactive material). All work must be completed within 180 calendar days of contract award. Bidders must submit a cost proposal, evidence of prime and sub-contractor experience, proposed equipment list, proposed work plan, project history documentation, and a 5% bid bond. Proposals are due February 19, 2025, at 1:30 PM Eastern Time, with written questions due by February 10, 2025, and Commonwealth responses issued by February 13, 2025. Site visits are strongly encouraged to assess tank removal procedures and reclamation requirements. Evaluation criteria include cost (45 of 70 points), prime and sub-contractor experience (2 points), project history (5 points), equipment availability (6 points), work plan completeness (6 points), and past performance with the Division of Oil and Gas (6 points), with proposal evaluation scheduled for February 26, 2025, and anticipated contract award by March 7, 2025. Liquidated damages of $200 per calendar day apply for work not completed by the established final completion date.

The procurement documentation does not specify set-asides for disadvantaged enterprises, minority-owned businesses, or other targeted vendor classifications, though the Commonwealth notes that Kentucky resident bidders and qualified bidders may receive reciprocal preference in cost scoring. No incumbent contractors or existing infrastructure integration requirements are identified in the solicitation materials. The successful bidder must furnish a 100% Performance Bond and a separate 100% Payment Bond within five calendar days of selection, and the contractor must obtain evidence of satisfactory completion through manifests documenting proper disposal of all contaminated materials and Abandoned Tank Site Closure Affidavits for each site before final payment. Payment will be made monthly based on applications for payment approved by the Architect-Engineer, with 10% retainage withheld until 50% project completion, then reduced to 5% retainage thereafter, and final payment within thirty working days of invoice receipt in accordance with Kentucky Revised Statutes. Additional compensation is available for TENORM disposal costs exceeding twice background radiation levels and for contaminated soil removal exceeding estimated tonnage, provided costs are documented and approved by the Division inspector. The solicitation does not disclose specific contract award amounts or budget ranges. Prospective bidders should contact Kristi Sharp at 502-330-9858 for additional information. The Commonwealth is not tax exempt, and winning bidders are liable for Kentucky sales and use tax.
