About this opportunity

The Commonwealth of Kentucky Finance and Administration Cabinet, Division of Engineering and Contract Administration, in conjunction with the Kentucky Energy and Environment Cabinet and Division of Oil and Gas, is seeking competitive proposals for general construction services under the Kentucky Abandoned Storage Tank and Orphan Well Reclamation Program (KASTOW), funded through the Bipartisan Infrastructure Law administered by the U.S. Department of Interior. This firm-fixed-price Request for Proposal (RFP-141-23) requires contractors to plug and reclaim 23 orphan well sites located in Powell County within the Miller-Prewitt Goff Heirs lease area. The scope of work includes properly plugging wells in compliance with KRS Chapter 353.562-564 and 805 KAR 1:060, removing aboveground flowlines and production infrastructure, conducting comprehensive site remediation and reclamation to establish permanent vegetative cover and effective drainage, submitting plugging affidavits and manifests, and completing all work within 24 months (730 days) from the contract award date with an additional one-year period to establish vegetation. Contractors must demonstrate experience with well plugging and workover personnel, provide corporate qualifications with well plugging references, submit complete proposals, document past experience with the Division's State Plugging Program or similar programs, and propose adequate equipment and detailed work plans. The evaluation committee will score technical proposals on seven criteria including prime contractor experience, project history, equipment adequacy, work plan completeness, past performance with the Division of Oil and Gas, proposal completeness, and total project cost, with the cost proposal scored on a 40-point scale where the lowest bid receives maximum points. Proposals were due by 3:00 PM Eastern Time on November 18, 2022, with an anticipated contract award date of December 13, 2022, and all submissions must be uploaded as single PDF documents to the Commonwealth's FTP site including the signed solicitation face, latest addendum acknowledgment, technical proposal, cost proposal, transmittal letter, required affidavits, and various certifications.

All successful bidders must comply with the Davis-Bacon Prevailing Wage Act, requiring contractors and subcontractors to pay laborers and mechanics prevailing wage rates as determined by the U.S. Department of Labor, and must submit weekly payroll documentation and compliance statements. Kentucky resident bidders are eligible for reciprocal preference under Kentucky regulations, and qualified bidders or the Department of Corrections Division of Prison Industries may receive additional preferences. The successful contractor must furnish a 100% Performance Bond and separate 100% Payment Bond within five calendar days of award, and must submit a bid guarantee of not less than five percent of the lump sum base bid. Liquidated damages are assessed at $200 per calendar day for delays beyond the substantial completion date and for delays beyond the final completion date. Additional federal requirements include compliance with the Build America, Buy America Act, Department of Interior Standard Award Terms and Conditions, Title VI of the Civil Rights Act of 1964, and all applicable environmental and labor standards regulations. If TENORM (Technically Enhanced Radioactive Material) impacted metals are discovered exceeding twice background radiation levels, contractors will be reimbursed for documented disposal costs plus 10 percent administrative charges upon presentation of required shipping manifests and proof of proper disposal. The RFP documents do not specify a total contract award value or budget range; however, the project scope encompasses 23 orphan well sites with individual site costs to be submitted by bidders, allowing the Division to delete individual sites and adjust the contract price accordingly based on these itemized costs.
