About this opportunity

The Wisconsin Department of Natural Resources (DNR) is seeking qualified consulting firms to perform remedial design services for sediment containing Toxic Substances Control Act (TSCA)-level polychlorinated biphenyls (PCBs) in the Milwaukee Estuary Area of Concern. This procurement, funded through an EPA Great Lakes Restoration Initiative (GLRI) grant, involves comprehensive environmental remediation design for approximately 15,000 cubic yards of contaminated sediment primarily located in the Milwaukee River Downtown Reach and a secondary location in the Kinnickinnic River. Key deliverables include reviewing existing investigation data, recommending additional testing, preparing a Quality Assurance Project Plan, developing pre-design investigation workplans, conducting geotechnical analyses of seawall stability, and preparing engineering design plans and specifications at 60, 90, and 100 percent design stages. The Statement of Qualifications (SOQ) is due on October 16, 2023, at 2:00 PM CDT, with a public opening at 3:00 PM the same day. Top-rated consultants will be invited to submit formal proposals by late November 2023, with contract selection anticipated in early January 2024, and the selected consultant must be a registered professional engineer licensed in Wisconsin.

The procurement has specific set-aside and participation requirements, including Disadvantaged Business Enterprise (DBE) goals of 5 percent for minority-owned businesses and 1 percent for disabled veteran-owned businesses. The contract is subject to Build America, Buy America provisions, mandating that all iron, steel, manufactured products, and construction materials be produced in the United States. Indirect costs for the contractor are allowable at 10 percent or less, and all data, documentation, and innovations developed will become the property of the State of Wisconsin, with EPA retaining rights to reproduce and publish materials for federal purposes. While no specific incumbent vendor is mentioned, the project involves collaboration with multiple non-federal partners, including the City of Milwaukee, Milwaukee Metropolitan Sewerage District, Milwaukee County Parks, and We Energies. The professional services contract is funded entirely through the EPA GLRI grant (No. 00E0453) with no required cost share, and potential future extensions may include engineering oversight for remediation implementation, pending funding availability and consultant performance.

Opportunity text

The United States Environmental Protection Agency (EPA) Great Lakes National Program Office (GLNPO) has awarded the Wisconsin Department of Natural Resources (DNR) a Great Lakes Restoration Initiative (GLRI) grant (No. 00E0453) to complete the remedial design for sediment having polychlorinated biphenyls (PCBs) greater than 50 parts per million (ppm) ("TSCA sediment") in the Milwaukee Estuary Area of Concern (MKE AOC).

Through the Cooperative Agreement, the EPA provides the funds and the DNR manages, scopes, and hires a contractor through Wisconsin Administrative (Wis. Admin.) Code ch. NR 734 for remedial design service. The EPA retains approval authority; intends to be involved in this work; and has certain federal requirements that must be met for data quality, the federal register and grant reporting.

The DNR Remediation and Redevelopment (RR) Program is seeking Statements of Qualifications (SOQs) from qualified consultants interested in assisting the DNR with the remedial design of TSCA sediment in the MKE AOC. The DNR intends provide request for proposals (RFP) to top-rated consultants from the responsive SOQs and to select one consultant for a Professional Services Contract for the remedial design of TSCA sediment from the responsive proposals.
