About this opportunity

Minnesota's Department of Administration is soliciting reissued proposals under contract release H-63(5) for full-service environmental emergency response contracts available to state agencies and Cooperative Purchasing Venture members across all 87 counties, with written questions due November 12, 2026 at 2:00 PM CT. Responders must have been in business under their current name or Federal Employer ID Number for at least five years from the due date and must maintain fully equipped operational facilities and offices within the seven-county metro area (Anoka, Carver, Dakota, Hennepin, Ramsey, Scott, and Washington counties). No set-asides are explicitly selected. The solicitation awards up to 120 preference points for certified targeted group, economically disadvantaged, or veteran-owned businesses and encourages small-business participation through Minnesota's Small Business Procurement Program.

Responders must furnish all labor, tools, equipment, materials, transportation, and supplies for 24/7 statewide response to spills and releases of petroleum, food products, manure, sewage, solid waste, hazardous materials, hazardous substances, and hazardous wastes on land, water, or air. Mandatory staffing includes a minimum of eight field technicians, four field supervisors, one scientist, two project managers, and one engineer. Required equipment includes vacuum trucks, skid steer loaders, boats, containment boom, pumps and skimmers, and three levels of personnel protection equipment. Responders must own this equipment and certify ownership under oath, though items obtained through Cooperative or Mutual Aid Agreements are excepted, and the State may conduct on-site verification. Insurance minimums are $2.0 million each for automobile liability, commercial general liability per occurrence, pollution liability per occurrence, and professional liability per claim. Prevailing wage rates under Minnesota Statutes 177.41 to 177.44 apply to state-funded work per Exhibit A Supplement 1, and Workforce and Equal Pay Certificates from the Minnesota Department of Human Rights are required above specified contract thresholds unless an employee-count exemption applies. All information storage and processing must occur within U.S. borders.

The estimated annual contract value is $1.5 million to $2.0 million, which is neither a minimum nor a maximum obligation. The contract is non-exclusive, with a term of March 1, 2027 through February 28, 2029 and an option to extend up to an additional 36 months in increments determined by the State. Non-Minnesota contractors face an 8% withholding on cumulative payments exceeding $50,000 unless exempt. Responders must submit the Mandatory Price Schedule (Exhibit D) with hourly and/or daily rates for every line item, and omitted mandatory pricing results in rejection.

Evaluation uses a 1,000-point system scoring acceptance of state terms, experience, violations history, required tasks and classifications, previous emergency response experience, emergency response scenario response, and cost detail. Questions go to Craig Fernholz, Buyer, at craig.fernholz@state.mn.us. Proposals are due November 18, 2026 at 2:00 PM CT through the SWIFT Supplier Portal, and evaluation is anticipated to conclude January 29, 2027.
