About this opportunity
The State of Maine's Division of Purchases is soliciting bids for Howitzer Paints and Coatings Products, with bids due May 13, 2010.
The procurement is governed by the Division's standard General Terms and Conditions of Purchase Order. All supplied articles and services must conform to specifications, be of merchantable quality, and be free from defects in material and workmanship. The Division retains the right to inspect all articles after delivery and may reject any shipment where sample inspection reveals ten percent or more of articles are defective. Delivery must strictly adhere to the Division's specified schedule; the contractor bears the cost of expedited routing if delivery schedules are not met. The contractor must provide original and duplicate invoices promptly, showing the purchase order number and vendor number for each shipment.
The Division maintains broad authority to modify, increase, decrease, or eliminate any portion of work and articles through written alterations, with corresponding adjustments to contract amounts. Default may result from failure to meet delivery schedules, failure to deliver specified materials or services, failure to perform any agreement provision, or inability to make adequate progress. The Division may terminate the agreement in whole or in part and procure similar articles or services elsewhere, with the contractor liable for any excess costs incurred.
The agreement is governed by Maine state law and includes compliance with applicable federal, state, and local laws, including environmental regulations under the Clean Air Act and Clean Water Act for contracts exceeding $100,000. All hazardous chemical suppliers must provide current material safety data sheets to direct purchasers. The contractor warrants that no collusion or restraint of competitive bidding occurred in connection with the contract award.
